URGENT DEADLINE ONE PARKING SOLUTION APPEAL HELP NEEDED

Hello All,
I thought I had posted this question already, but can’t find it? May be my dizzy head? 🙄
A family member drove in and out of a road leading to access behind the shops, with a few parking spaces, she did not park. She was sent a NTO camera derived parking ticket. She replied online simply stating that she had not parked & merely driven in and out. Certainly if as per other posts I’ve read a 10-15 min grace period this was not reached. 

The vehicle is registered in a company name, so obviously when appealing online the company name on the letter was used to correspond with their info to identify the vehicle/ticket etc.

They have responded by saying as name and address not provided the appeal cannot be accepted & if an appeal is to be lodged the info must be received by TODAY! (Their email was sent on 13th but only just been found.)

Is it correct that they can refuse the appeal like this, if so I shall advise to send it in?

I believe in saying they drove in & out if supplying this further info it would identify them as the driver, would that matter?

    Was it really an NTO or was it a NTK? Unless byelaws apply the owner cannot be held liable, only the keeper or driver.

    Was the driver's identity revealed in the initial appeal/attempt? 

    What exactly was put in the appeal?

    If there is any doubt, send an appeal using one of the edna basher letters from the NEWBIES Announcement. There are three to choose from so make sure you pick the one that suits an appeal from the company exactly as the name shown on the V5C.
    Both a name and address must be included in the appeal, so I would suggest the business correspondence address might be the most appropriate.

    Please tell us where the alleged event occurred as it is quite likely the location has cropped up here before.

    Please also tell us the date of the alleged event and the date of issue of the NTO/NTK, and when it was received.

    I wouldn't worry too much about the appeal with them. They want your money and will do whatever it takes to get it from you. The "appeal" will most likely be rejected because the House always wins. Its not an unbiased or legally binding process- just a kangaroo court so don't worry too much about it or "losing" as it's all part of the con show!!!

    The good news is that there is a far higher chance of winning in court because this is the only truly independent forum.

    I think it was a NTK actually, because it was the registered keeper details, ie, the company.

    Driver identity not revealed but spoke in the first person on the appeal.

    Will take a look at Edna Basher letters, but when you say give name & address, can that be the same name & address of the company, or does it have to be a person?

    I believe the appeal was very brief, just I did not park, I drove in and out?

    If the appeal said the words, I drove in and out, and the name of the person who appealed was given, then keeper liability is irrelevant and the valuable non-PoFA compliant NTK point goes out the window.

    However, if the PPC is now saying that no name and address was given, it effectively means that no appeal was made. It is important therefore to fire in an appeal asap giving the company name and a company address for service. This can be the premises from which the company operates or the address registered at Companies House.

    Gosh Fruitcake, I can’t remember to be honest, I certainly appreciated everyone’s help, I know my daughter has a hefty fine that she is still paying off deducted directly from her disability monies, but she did manage to keep her licence. I’m wracking my brain, I think I had to get a local solicitor to deal with it because they listed it in a court miles away for whatever reason and I gave him proof of posting etc. I was just reading it myself a minute ago and it brought back some painful memories of the stress I was under at the time, albeit nothing has changed 🙄 one day!?

    I am sorry, whaaaat?  You don't get a fine from private parking firms, nor does anyone have to pay them off and your licence is NEVER under threat.

    This doesn't happen.  What do you mean, they can't deduct monies from her disability allowance.  Is that a different matter?
    PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

    We really need to know what happened. We need to know the date of the alleged event, the date the NTK was issued, the date it arrived, and most important of all, what was put in the first appeal and precisely why it was rejected.

    Getting information second hand makes the whole process very difficult. Basically we are flying blind until you or better still, the family member can give us precise and accurate information.
