Buyers solicitor didn't send for searches

Hi,

We accepted an offer on our house beginning of August, our buyer paid for her searches and our EA told us that her solcitor has sent for the searches. We found our onward purchase end of September and we instructed solicitors. Since then our house we are selling was downvalued so we renegotiated with the buyer. We assumed her search results would be back very soon as we had been told they had been paid and sent for in Ausgust. Well, today I decided to contact the council and was told that they have had no search requests for this property and their current turnaround time is 40 working days. Our EA chased the buyers solicitor who confirmed that although they have the search money; it is their policy to not request searches until they have a mortgage offer!

Apparently the buyer didn't know this, she is buying our house to rent out and want things to go through as quickly as possible as do we. We were hoping for the end of November for completion. I have asked the estate agent if she can see if the buyer would consider search indemnity insurance as we just cannot wait 40 days for her searches to come back when we have been mislead all along. Any advice on what we should say/do?
