eviction times in current climate

i have been given a s21,  it's all in order as the landlord mucked up the last one.

As a family we have struggled and been turned down for many houses,  as we have been getting UC as a top up to wages and we have a dog.

My situation has now changed,  my husband the wage earner died suddenly 6 weeks ago and the bit of savings I had went on costs associated with that.

I am still waiting for a death in service payment from his boss and don't have 3 months of new regular UC payments to show affordability in referencing with estate agents( previously was ok)

they can apply to courts in November but I need to know how long its taking as to whether I ask them to delay court till I sort finances.  if its still 6-8 months I don't really need to ask them but of its less I may do so.

the death in service may be enough for a large deposit and my son getting a small mortage so I want to get as much time as possible to sort everything and avoid moving twice as I know I won't have alot of spare cash to play around with.

    Firstly ,very sorry for your loss and it appears you will be financially ok in the not too distant future .

    I can only give you times pre-covid so would assume it will take longer .

    I issued a S21 & S8 to one of my tenants in 2019 and from start to finish it took over a year so based on this timescale you will have plenty of time to sort through everything

    I am so sorry to hear of your loss. What a terrible time for you.

    Evictions are still taking many months. The last I heard, there's still a major backlog in the courts, and even when the LL gets a court order there's then a queue for the bailiffs. You've probably got a year. If it does become a pressing problem, the council have a duty to house you, so you won't be on the streets.

    One word of unasked for advice: It may be better not to involve your son in the house purchase. Or, possibly, the lenders will accept him just as guarantor. He can still contribute as rent if he is living with you.

    You can otherwise get into the position that he can't go off and buy his own home later. Or, you could lose your home if he goes bankrupt/gets divorced. 
    No reliance should be placed on the above! Absolutely none, do you hear?

    he wants to do it,  he likes living at home as does his partner,  he is going into it with his eyes open and its not set in stone yet as we may not have enough money and end up private renting again.   sounds like we have time to think as I'm all over the place at the moment and don't want to think about it just yet

    You can phone your local court and ask what the waiting time is for a possession order after S21 notice has been served.  If it gets that far, you can also ask for more time until the possession order notice ends.  However, be prepared that the judge normally awards costs to the person being evicted.  In my case a few years ago it was just under £500 for both the Possession Order and Bailiffs warrant.  I arranged with my LL to take the money from my deposit but obviously he didn't have to agree.
