Minster Baywatch first letter asking for £155

Options

Hi there,

My father as the registered keeper recently received a 'demand for payment of unpaid charge' from Minster Baywatch. This is the first letter he has received and they are asking for £155. They say the date of contravention is 13/08/21.

I was driving the car at the time, I was returning from hospital and I felt sick and stopped in a car park for around 30 minutes. I didn’t leave the vehicle and just waited until I felt better, didn’t even consider payment of the fee for the car park unfortunately.

The letter was received only a few days ago, and it states that they have previously written and offered an initial lower amount of £60 then the higher amount of £100. It goes on to say these payments have not been made so its been passed on to their internal collections team with an additional charge of £55, with the total charge now being £155. It says the amount of £155 is due by 06/10/21 which has already passed.

It says at the bottom if you do not pay the full amount or have not agreed a payment schedule by 6/10/21 they will look to refer the account to their litigation department etc .

Im willing to pay the original demand of £60 had they sent the letter, but now its £155 its excessive.

Can anyone advise how to handle this given they have not sent out those earlier letters they say they have.

Many Thanks

It shoukd never exceed £100, read ths and complain yo yout MP.

They have added what appears to be an extra unlawful amount for debt collection. Judges have dismissed an entire claim because of this. Read this and complain to your MP.

    Excel v Wilkinson

At the Bradford County Court, District Judge Claire Jackson (now HHJ Jackson, a Specialist Civil Circuit Judge) decided to hear a 'test case' a few months ago, where £60 had been added to a parking charge despite Judges up and down the country repeatedly disallowing that sum and warning parking firms not to waste court time with such spurious claims.   That case was Excel v Wilkinson: G4QZ465V, heard in July 2020 and leave to appeal was refused and that route was not pursued.  The Judge concluded that such claims are proceedings with 'an improper collateral purpose'.   This Judge - and others who have since copied her words and struck dozens of cases out in late 2020 and into 2021 - went into significant detail and concluded that parking operators (such as this Claimant) are seeking to circumvent CPR 27.14 as well as breaching the Consumer Rights Act 2015.   DJ Hickinbottom has recently struck more cases out in that court area, stating: ''I find that striking out this claim is the only appropriate manner in which the disapproval of the court can be shown''.

Minster Baywatch are feeding you RUBBISH

What they mean is it's been passed to another desk ???  VERY FEEBLE attempt to extort money.

For that "desperate for money" fake add-on, a judge would kick them out of court.
THE PARKING TICKET IS £100 ... PERIOD.

Get wise though ... the next thing will be a numpty debt collector WITH NO POWER, adding another £60.   TO BE IGNORED

Not only is this a scam industry it's full of numpty types as well.
SIMPLE .... YOU DO NOT OWE £155, YOU ARE BEING SCAMMED

Minster Baywatch are BPA members, which offers more prove that the BPA cannot control their members

Guess what, the numpty debt collector will probably be a BPA member as well ???

You must ignore scammers and report them to your MP to investigate

Thankyou for the replies. I have a lot to read to educate myself but I would like to fight back against these scammers, why should we fund these fat cat bully boys enjoying nice holidays and big houses by preying on the vulnerable, it sickens me.

Ok, so I think from what I have read so far I need to complain to the landowner first.
It was Gala Bingo car park. The issue is I didnt leave my car or use Gala bingo, should I still go ahead and put the complaint in?
Also, is there no need to stress over the deadlines and dates they have written as im well over them now due to the letters arriving this week.

If your relative is the keeper and MB are writing to him , it's nothing to do with you , yet , it's him that they will sue in court

Get him to name you as driver , citing POFA 2012

Once the PCN is in your name as driver , you can deal with it , until then , it's his legal responsibility , not yours

He can complain to gala bingo , you can assist him

Sorry to read about your troubles with Parking fines.

I would be very interested in the original text of Baywatch Notice or Appeal response they appear to be using a set of generic letters regardless of circumstances?

    Many thanks

@MaxMJ - just a word of advice, please stop the repeated posts. MSE don't like it and it could lead to you a ban of a temporary (or permanent) nature.

If you have a parking case with Minster Baywatch with which you want some help, please read the NEWBIES FAQ Announcement, first post, to get you started on the process, but if you need further help beyond that, please start a new thread of your own with some background details.
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.
