Using car wash

I have received a County Court summons for using Tesco valet hand car was service. Basically went to get my car washed, was told it was at least an hours wait by the attended. I ask the if I could pick my car up in 3 hours as it wouldn't be worth me walking home and back if not. Attended said yeah that's fine. Received the penalty notice, rang tesco directly how gave me an email address to appealled to, no reply. Now I've been sent a County Court summons. I have proof of payment to the car wash and proof of an appeal sent. Do they have a case, will this even make it to court?

I would say they if this went to court, they are likely to struggle mightily
It is neither a penalty nor a summons, please read the newbies and complain to your MP. Does the car wash have a website or Facbook page? If so consider writing bad stuff on it>You never know how far you can go until you go too far.1 -
How have you received a claim form (NOT a summons, it's civil not criminal) without any other correspondence, debt recovery letters, letter before/of claim? Have you moved and not updated your V5C with DVLA? Yes, they have a case, yes it could make it to court, you need to press Tesco to sort out their hand wash people - but of course there may not be any contract between the valeteers and Tesco. What is the date of issue of the court claim (N1) form.1

Thanks. I received one letter asking to pay a fee for over parking, which I appealled and never gave a second thought that I could be at fault, and 4 years later a letter from the County Court. Ironically the car was scrapped due to an accident a few days after so it was a waste of money and time getting it cleaned anyway. We also moved house a few weeks later. Maybe 6 to 10 weeks, I don't remember exactly how long but I could find out.Le_Kirk said:How have you received a claim form (NOT a summons, it's civil not criminal) without any other correspondence, debt recovery letters, letter before/of claim? The letter has 4 forms: a N1SDT claim form, a N9SDT response form, a N9A form of admission, and a N9B defence and counter claim form.0 -
Thanks. Sorry you're right it's a N1SDT claim form. I'll look into contacting the car wash. I'm not sure if they are nationwide, but they are in all the Tescos in my area.D_P_Dance said:I would say they if this went to court, they are likely to struggle mightily

That car wash will have a contract with Tesco anyway. Tesco would not want the bad publicity this might engender. I would still try to pressure Tesco into getting this withdrawnThe pen is mightier than the sword ..... and I have many pens.1
