I’m thinking of buying a set of AirPods Pro. I already bought a pair but had to return them to Amazon because of a manufacturing fault. Received a full refund so no problem there.
Before re-ordering I decided to look at other suppliers. John Lewis was offering a two year guarantee but when I contacted them I was advised that when I broke the seal I could no longer return them as unwanted, only if there was a fault. But I had to try them to see if there was a fault, to see if they didn’t fall out of my ear. A common enough problem it seems
i know that if you buy underwear, a CD, software, and try them on or break the seal then you can’t return. I’m ok with that but I’m wondering if the like of AirPods fall into that category as you may have put them in your ear.

Going back a bit but there was a thread on mattresses where the EU courts ruled they were not exempt from the right to cancel due to hygiene issues as they could be restored to their original condition.
This thinking renders 99% of items ineligible for the limits to the right to cancel for hygiene reasons.
With these in ear headphones really the changeable buds could be replaced with new ones and the customer would be looking at a reduction in the refund for diminished value.
John Lewis are likely to stand firm on their position of hygiene and it's hard to say which side would win with small claims.In the game of chess you can never let your adversary see your pieces0 -
The earlier thread you are referring to is the one that was concerned with the return of some vaping paraphenalia and whether it was sealed for hygiene purposes. unholyangel referenced an earlier European Court decision which, as you suggest, said that if the goods could be restored to their original "hygienic" condition - by cleaning - then they did not need to be sealed for hygiene purposes, and could therefore be returned as a "change of mind" - if bought online.
This was "vigourously" debated over several pages in the thread and I'm not sure it was ever resolved.

As you have already had a pair, you should know if they fit or not. Or Apple so tight that they do not provide silicone tips in various sizes to fit various sized ears we all seem to have. Which other ear bud suppliers do?Life in the slow lane0 -
If you have a problem with ear pods falling out then maybe you should consider looking at custom jobs based on taking a mould of each ear.0
