Although you are trying to have this resolved to your benefit, do not ignore the response date supplied with the Simple Procedure.
You should be able to state that you're going to defend the case, but not have to provide any details immediately. If you don't do this, then Horizon shall be given a decision by default, as the court shall assume you aren't interested in fighting it.
Although you can haul a decision back into court after it has been granted, it'll be more of an uphill battle to do so. So get your response in, and then go about gathering the evidence you need to fight it. Obviously, record everything and make certain that people you are requesting information of are aware it's for a court case.3 -
Yes I was going to say similar, there must hopefully be a way, as there is in England, of acknowledging and saying you intend to defend, and that buys you more time. We don't know, so read up on that or ask for urgent confirmation of that at least from the free advice services, CAB if you have to, just to establish that.
Have they not added fake debt recovery sums on top of each PCN, taking it over £4k in total? Or is it 'just' for the £100 PCNs racked up when awaiting the inexplicably delayed permit (a permit scheme that this Claimant presumably has a hand in)?
Reminder: please look at my first reply for how you should approach the defence, in my view. I am not legally trained so this is 'take it or leave it' consumer advice, of course, merely given in my experience suggesting that you tell the truth, admit to driving and talk about the permit application delay causing you this unfair and disproportionate detriment.
Don't let your law centre tell you that either the Beavis case (Supreme court) or the Carly Mackie case (Scotland) means you have no defence. Your case is not like either, and in the latter, she was parking with no permission and offered a useless defence that 'PCNs are unenforceable' pretty much.
You are not saying that. You are saying that, at least on the dates of some (all?) of theses PCNs, the Claimant or their client managing agent, knew you had rightfully applied for a paper permit snd should have fairly had your VRM on the site 'whitelist' which was entirely within their gift.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Coupon-mad, that’s where the problem is. I didn’t request to be added onto the permit until after these tickets. But I was thinking surely that shows I was eventually authorised to park and hopefully the judge would see that? I’ve started drafting up my defence but I have no idea how to word anything or explain in a formal matter. I’ll post on here once I’ve got my first version.0
