Have you read the newbies?  Have you complained to your MP?
You never know how far you can go until you go too far.
  • yes read newbies forum not complained to mp yet just received today,am i replaying wuth first appeal template on newbies forum?
    many thanks

  • Hi
     Good morning.
I dispute your 'parking charge', as the keeper of the vehicle. I deny any liability or contractual agreement and I will be making a complaint about your predatory conduct to your client landowner along with a complaint to my mp for this to be brought up in parliment.

I will also make an appeal though popla and will defend any claim against me in court.

The Keeper should appeal using the template in blue text from the NEWBIES. Send it unaltered save for a one liner that The Driver was making a delivery and picking up/dropping off/delivering is not parking as determined in the persuasive appeal court case of Jopson vs Homeguard.

PoPLA is not an option so do not mention it. You really need to go back and re-read the NEWBIES as this is explained there.

You shouldn't be telling the world who was driving either. If you are able to edit posts you should go back and correct your first post where you gave this away.
You have also left your PCN number showing. That needs to be redacted as well.

Look up the transcript of the case I mentioned as it is available online. Look around paragraphs 19 and 20 for the judge's comments.

What happened when the keeper complained to the landowner and the person/business receiving the delivery?

You may wish to complain to the PPC and IPC that the NTK states that "you should notify us of the name of the driver."

There is no such requirement in the PoFA. A PPC may invite the keeper to name the driver, but there is no obligation or legal requirement for the keeper to do so. Use of the word, "should" implies an obligation to the keeper that does not actually exist in law. It is a false instrument, and untruth. In other words, it is a lie.

So you parked about here, with only a CCTV signage in view.

but the only parking sign that I can find is further along (and one opposite)

You may wish to get your own pictures of the signage asap as it seems inadequate for purpose.

Also state that the car was not parked, as a matter of fact and degree.

You won't be making an appeal via POPLA as UKCPM are not BPA AOS operators. Rather they are IPC AOS operators where the IAS is the second level appeal (dis)service!  The NEWBIES FAQ Announcement, third post, will explain the second stage appeal processes - but not for now. Await your initial appeal outcome, then go from there.
