Returning unopened paint

Hello, I bought two tins of Frenchic paint from a local store. One of these I do not now need, I tried to return the tin along with my receipt but they have refused to exchange or refund (I just wanted to exchange for another colour) they stated that it there policy not to refund or exchange on Frenchic paint due to not knowing how the paint is stored once it has left the building 🤷🏼‍♀️
Surely as this is an “off the shelf” colour and I have all the documentation I legally should be allowed to return this? I have emailed Frenchic who have said that they are just suppliers and it is down to the stores policies.
I’m sure I will use the paint somewhere 😂 but am I correct or not in thinking I should be able to return this?

As above, there is no automatic legal right to return an in store purchase unless their terms allow for it.

Do you mean they advertise a general policy that you can make returns, but that they didn't clarify this exception?

The general rule is that if you buy something in-store (as opposed to online) then the store is not obliged to allow you return it unless faulty.

That said, many stores (especially large ones) do have returns policies, but even these may have exclusions.

The don't need to give a reason!

As others have said, unless you bought it on specifically agreed terms that it could be returned (normally an advertised store policy but it could be a one off agreement for your purchase) then the default legal position is that you cannot return it unless faulty.
  • No, you're incorrect in your understanding.
You have no legal right to return, sorry.

With in-store purchases there is only a right to return if the item is faulty or does not match the description.  Because it has become much more common over recent years for shops to accept returns many people do believe they have the right to do so.

I think you're being a little unfair. What if it they refunded it and then resold it to you... and when you got home you found the paint was ruined as it had been kept outdoors?
