Music Magpie - Phone reported lost

Good afternoon,
Other half recently attempted to sell working phone via music magpie , who then notified her her phone was reported stolen and they would be keeping it unless issue could be resolved in a couple of days
Confused, it turns out several years ago she lost her phone, reported it stolen to phone carrier, but called up again the next day to say she found it. There was never any block on the phone during or after the 2nd call so had no idea this external stolen phone report even existed, or knew what 2nd call wouldn't have resolved it if it did.
We called and they said they would remove the block, they haven't, and now refuse to talk to us without the imei which we do not have in any saved file, document or applie id etc. So we can't talk to them at all about it.
Music magpie now seem to be saying they will be keeping the phone, which seems to be in the t&Cs but still seems ridiculous.
Would we be able to recover the lost price of the phone we would have got from the phone carrier, for not removing this stolen phone report way back when, and for not removing it when they said they would this time ?
