Who pays rent in student house when one student is evicted

    Plus asking the landlord to explain precisely why the agent has said the tenant/guarantor isn’t liable and they can’t chase them for the money. 
    I’m in the camp that if they’ve gone down the illegal eviction route, they should carry the can fir the shortfall till it’s resolved. 
    I’m reluctant to approach the landlord just yet in case I get caught up in something that makes me viewed as ab easy target to get the rent shortfall.  But if she contacts me I’ll definitely ask her. 

    My son has had a missed call from her so I’ve briefed him on what to ask her when he calls her back and what not to agree to. E.g a 6 person tenancy. Not saying that he wants tenant to leave. He’s been careful to say ‘ I don’t think I can live with him’ rather than he must leave.

    Hi,

    I have a different take on some things:

    1. It is not in your children's interest for the tenancy to continue to name the tenant who has left - they may decide to start living there again. (It is in your interest as it increases the pool of people who can be called on for money, but I'm guessing you would put your interests below your children's),

    2. The landlord is entitled to their money and can choose which tenants or guarantors to retrieve it from. It may not be in the landlords interests to pursue the tenant who has left and they are not obliged to.

    3. The tenants who remain can pursue the tenant who has left (but not their guarantor) based on their agreement to rent a house together. I recommend they think carefully as to whether that is a good idea as that tenant may choose to return if they have to pay the money anyway.

    4. I think the upshot off all this will be that either a replacement tenant is found or the remaining tenants pay 1/6 each of the full rent - trying to go down a different path will result in a lot of pain and not necessarily achieve anything.

    5. What does the university accommodation  office say about all this?
