You need to do 2 things:
1. WRITE to the tenant making it clear that they are in rent arrears and owe £X and that they have 28 days to pay it. I would then say that as the LL was in hospital and unable to be contacted for a short period of time, then as a gesture of good will you will be reimbursing them for any essential maintenance they paid for providing a receipt can be given to show what was done and when.
(check your brother's email to see what they tenant emailed about)
2. Issue an eviction notice. Go through the guidelines of how to serve it properly. Serve one for rent arrears (S8) then another no fault eviction notice (S21) alongside it just in case they do suddenly pay their rent.Should've = Should HAVE (not 'of')
