Small claims court

Complete waste of time, took a business (limited company) to court, and won. They refused to pay, options either bailiffs but as only a mailing address pointless as no assets to cease or winding up order, costs me £1600 + Fees to set up, then they will probably liquidate the company so I lose everything. Found out subsequently that this company has 8 CCJ's against it........... What a mess and no help from the courts only costs!

Any advise welcome................

    Unfortunately the time to think about whether they've actually got the money to pay you is before you spend more time/money at court.
  • Yup, as above - if you only have a mailing address and the company has no cash, then it's probably wasted money pursuing them. 
    I've taken several companies to court (and won) but I've also chosen not to bother with several others because I did my homework first, and there wouldn't have been much point.

    Don't blame the court, their remit is to hear cases and make judgements, not recover debts.
    If you are querying your Council Tax band would you please state whether you are in England, Scotland or Wales

    I'm afraid it's up to you to decide whether it is worth taking a company to court or not.

    After all, winning is pointless if they have no assets you can have seized to cover the money owed.

    Does the company have no assets at all? No company vehicle? Computers? You haven't said what sort of company it is...

    The court are not to blame. They just decide who is right.

    No, I am not perfect, but yes I do judge people on their use of basic English language. If you didn't know the above, then learn it! (If English is your second language, then you are forgiven!)

    1. Third Party debt orders
    2. Winding up orders
    However the costs to set up these orders are on the shoulders of the claimants. I knew these people had the money but getting at it is another thing. 
    If they did not have the power to recover money why would you take people to court?????, just so you could say you've won????. I took them to court to get the courts to help me recover the costs.

    Of course it is. a) once you pay them to do so, and b) assuming they have anything to recover.
