Company has not picked up unwanted chair

My neighbour ordered a chair but the wrong colour was delivered.  She informed them and the right one came relatively quickly but they did not take away the first one.  The neighbour has repeatedly asked the company to come and get it but, for what must be over 2 months now, it is in its box in the common parts hallway of our building and is certainly a fire hazard.  Is she entitled to get rid of the chair, as she really does not want it?

    She can get rid of it if she wants, but the company has up to six years to pursue her for its value.  Best advice is for her to write to the company asking them to collect it within 14 days or she will sell it, and they are welcome to the proceeds.
  • The neighbour has become an involuntary bailee and has a duty of care towards the goods for which the retailer theoretically has 6 years to chase the value off. 

    Best thing to do is try Facebook for as close to paid price as possible and if the company come looking in the future offer them the money from the sale. 

    The item can't be sold for pennies but there isn't an expectation of getting full price either. 

    It's usually advised to write to the company giving them a reasonable deadline for pick up before selling.

  • I had this problem with a huge cupboard that was faulty. Company didn't want to know. I contacted my credit card company who got my money back but the company didn't want to collect the cupboard. Email after email, phone calls after phone calls. So I phoned trading standards. They told me to send a letter to the company outlining a timeline in which to come and collect it or I would be disposing of it myself. Never heard a thing from the company, but because it was such a huge thing I really had no idea how I was going to even take it apart, so I tried one more time with customer services on fb and I told them I'd been in touch with trading standards. That made them take notice and my cupboard got collected. So tell your neighbour to contact trading standards.
