Rights on Return and Refund

Hi,

I purchased some woodworking machinery from Mano Mano on 28/8/2021.

Price was competitive, and tools have been difficult to come by of late, so I thought I'd give the website a go.

Item duly delivered, but not used until Wednesday. 

On first use - third piece of timber, one of the cutting blades has bent. I was using the machine carefully so not misuse. 

I contacted the seller through ManoMano asking what my options are, and they have said they'll contact the manufacturer. 

There is so much info on the forum, it's difficult to find the exact answer, but I thought my contract was with the seller, which turns out to be "Nuts & Bolts Ltd
Whetcombe Whey, Ropers Lane, Wrington. Somerset. BS40 5NH".

What are my rights if I wish to return the item? I would like a replacement, but I feel this model the same will happen again? below are photos to show exactly what has happened. Wood chippings has accumulated behind the blade, and even where not bend it is accumulating .... 

I never spend big money on-line for tools for this exact reason, as I feel I am going to get the runaround. Dealing in store is so much easier!

  • Looks to be a thickness planer?

    It appears material has bunched up under the blade possibly from taking too much material off at a time. Do you have spare blades? 

    If you was looking for a refund under 30 day right to reject you'd have to show the goods do not conform to the contract if the retailer requests such. 

    If you allow them to repair or replace then it's taken the goods did not conform unless demonstrated otherwise and if after 1 repair or replacement the goods still did not conform then you could exercise the final right to reject. 

    Without more details it's hard to say but I think they might come back and say user error if the first two points above are correct.

    No a home/personal purchase.

    I t is a thickness planer, and if I was looking at the photos i'd say like you I was trying to take too much off, butI genuinely wasn't. Blades are quite expensive so I don't have replacement blades, yet.

    Hopefully metabo will come back with something like replacement blades? I have just seen a video on YouTube and the reviewer there also had the same problem.
