Trade Centre UK

I brought a car for £12,000+ (HP finance) I did put down a £4000 deposit (2015 plate Volkswagen polo with 49,050 mileage) from the trade centre on 28.09.21 and on the day when I was shown the car I was allowed to look at it, I was told “it’s a really good car for first drivers in really good condition for its age” this was spoken and I have no evidence of this but another eye witness. Also I felt like I was pressurised into buying the car on the day without sufficient time to make an informed decision. As they did say that they would knock of £700 from the car if I was to buy it on the day. 
But when I took it home I saw that it had a lot of scratches and scruffs and stains on the interior of the car.
I called up trade centre and they told me they can do nothing to help me and that I should have checked and asked the right questions myself. 
They do no refund at all and I was not made aware of this policy at all on the day of the purchase nor was I made aware of the defects in the car. 
I was told that the right of reject law helps the consumer. And that the law is above any companies T&C. 
I have sent a letter in to both the trade centre and Blackhorse finance company. 
But I am afraid that I would get no help and that It would have been my responsibility to check for any damages in the car.

  • You are correct that you can reject goods which do not conform to the contract regardless of a company's terms but buying a 5 year old car in person without noticing the condition of the interior doesn't put you in a good position. 

    Knocking some money off a car to encourage a sale is pretty common and I can't see this falls under pressured selling. 

    In order to go anywhere with this you'd have to show the faults weren't present when you viewed the car, which I think you'd struggle to do, unless you took picture on the day, and the claim may be viewed as buyer remorse unfortunately.

    I do understand why you felt pressured, but it is a fairly common sales tactic and, as our resident lunatic said, is probably not unfair pressured selling.

    Your consumer rights do give you a short term right to reject, but it is not for just any reason and has to take into account reasonable expectations for the age, mileage and condition of the vehicle.  In your case, all the faults you mentioned were visible at the time of purchase, so the time to raise these was before purchase and not after the car was back at your home.

    Why were you not able to view the car and notice these marks prior to purchase?

    It's not damage per se but wear and tear commensurate with a used, 6/7 year old car. You had all the time in the world to check the car out fully in person before purchasing it, or you could've simply walked away. I don't believe you have any rights to a remedy under the law.

    the car has turned off twice whilst driving and now it won’t turn back on at all. I have got it booked in for an inspection by my car finance company this Friday and the trade centre did say they can get it recovered on Tuesday from my house. But my job requires me to have a car. I am so stressed. Is there anything that can help me? I will still try to reject the car but is there anything I can do?

    the car has turned off twice whilst driving and now it won’t turn back on at all. I have got it booked in for an inspection by my car finance company this Friday and the trade centre did say they can get it recovered on Tuesday from my house. But my job requires me to have a car. I am so stressed. Is there anything that can help me? I will still try to reject the car but is there anything I can do? 
    Hire a car? Borrow a car from a friend and insure yourself on it? Take a taxi?
    You need to mitigate your losses, so if not working will cost you £200 and a taxi to work is £20, then take the taxi.

  • My job requires me to travel to houses (carer). Taxi prices will add up definitely. And I tried to get a hired car and courtesy car but my age and how long I held my license for does not allow me to.

    Then it's an economic decision: how much taxis or public transport would cost, versus lost income if you don't work.  Don't put yourself in a position where your reluctance to pay for transport puts your job at risk.

    The consumer rights matter with the dealer is a separate issue, so don't muddle the two.
  • UPDATE- Black Horse finance have reviewed the car inspection report and it does state the car has a fault. They called me on the 20.10.21 to let me know that they will go ahead with the rejection. And that the next step would be that they email the account manager which would take 48hours for his reply. It has now been 10 days and they still go no update. I am unable to work due to my job role needing a car (home visits) and to be able to buy a new car I will need a refund first for my current one. 
    I just  need help on what to do on my next step. I don’t see why it’s taking so long to collect the car and do the paper works.
