Heart Breakfast Road Trip ‘Win A Car’ Promotion on HEART, October 2021 – Specific Rules

1. The ‘Heart Breakfast Road Trip ‘Win A Car’ Promotion (‘Promotion’) is organised by Global Charities (as defined in the Global’s Make Some Noise Competition Terms and Conditions). The Promotion will run from Friday 01 October 2021 to Friday 08 October 2021 on the Heart Network and on Heart’s Win+ platform online. The Promoter is Global Charities. The Promotion Partner mentioned in these Specific Rules is Motorpoint.

2. IMPORTANT: THIS PROMOTION IS ONLY OPEN TO RESIDENTS OF GREAT BRITAIN AND IS NOT OPEN TO RESIDENTS OF NORTHERN IRELAND, THE ISLE OF MAN OR THE CHANNEL ISLANDS. The Promotion is subject to these Specific Rules and the Global’s Make Some Noise Competition Terms and Conditions which are available here. Entry into the Promotion constitutes acceptance of these Specific Rules and the General Terms and Conditions.

4. If you are entering the Promotion by SMS text message, you must send a text message with the keyword CAR to the shortcode 82122 (the “Text Message Line”) as directed by the presenter(s) on-air.

4.2 Entries received before or after these times will not be included in the Promotion but may still be charged.

4.3 We are not responsible for any latency experienced by your mobile phone network, which may delay the delivery of text messages to and/or from us.

4.4 Text messages will be charged at standard network rates. Standard rate text messages to promotion shortcodes are not normally included in ‘inclusive’ packages and may be charged. If entry is made by text message, be sure to use the correct shortcode. In all cases, please check with your service provider for more details and charges. If you are not the bill payer, you must obtain the bill payer’s permission before entering.

4.5 After entering the Promotion, you will receive a bounce back text message informing you that a voluntary donation to Global’s Make Some Noise (registered charity 1091657(England & Wales) & SC041475 (Scotland)) of £5 will be taken automatically, unless you text the word CANCEL as instructed. The £5 donation will be taken one hour (60 minutes) after the time the first text was received from the mobile phone used to enter the Promotion, and 100% of the donation will go to Global’s Make Some Noise.

4.6 For the avoidance of doubt, you do not need to donate to Global’s Make Some Noise in order to be eligible for entry to the Promotion. Anyone who texts CANCEL as instructed in the first bounceback message and thereby opts out of donating £5 to Global’s Make Some Noise will still be included in the prize draw.

4.7 You may enter the Promotion via SMS up to 6 times per car, however you must text CANCEL as instructed after each entry, to opt out of donating £5 to Global’s Make Some Noise. 

To enter online through Heart’s Win+ Platform

5 If you are entering online via Heart’s Win+ platform, you can access the Promotion hereand you must complete your entry by selecting whether or not you wish to make an optional donation of £5 to Global’s Make Some Noise and then entering the mobile phone number on which you wish to enter the Promotion.

5.1 The opening times for online entry through Heart’s Win+ platform will be as follows:

5.2 Entries received before or after these times will not be included in the Promotion but may still be charged.

5.3 We are not responsible for any issues or problems experienced by your chosen Payment Services Provider, which may delay the delivery of your entry to us. For SMS entries, we are not responsible for any latency experienced by your mobile phone network, which may delay the delivery of text messages to and/or from us. Furthermore, we are not responsible for any erroneous entries which may occur through a mobile phone network or handset error.

5.4 If you choose to make an optional donation of £5 to Global’s Make Some Noise, the donation will be charged to the mobile number you submit when entering the Promotion.

5.5 If you choose to make an optional donation of £5 to Global’s Make Some Noise, you will receive a text message once the Promotion has closed confirming your donation of £5 to Global’s Make Some Noise (registered charity 1091657 (England & Wales) & SC041475 (Scotland)) has been taken and charged to the mobile phone number you submitted when entering the Promotion. 100% of the donation will go to Global’s Make Some Noise.

5.6 For the avoidance of doubt, you do not need to donate to Global’s Make Some Noise in order to be eligible for entry to the Promotion. Anyone who chooses not to donate through Heart’s Win+ platform, and thereby opts out of donating £5 to Global’s Make Some Noise will still be included in the prize draw.

5.7 You may enter the Promotion online via Heart’s Win+ platform once per car.

Winner Selection:

6. Each day within 1 hour of the closing time of the Promotion round, all eligible entries for that round will be entered into a draw. One correct entry will be selected at random and the entrant will be contacted by one of our representatives via telephone on the number on which you entered. If the entry is ineligible, we reserve the right to select another entrant to participate in the Promotion or withdraw the prize and select another entrant, as applicable. This process will be repeated for each of the five competition rounds.

7. If you are selected as one of the 5 winning entrants, you may be asked to have a call with a presenter. You must answer your telephone when we contact you. Someone else cannot answer the phone, participate or accept a prize on your behalf. If: (i) you fail to answer the phone; (ii) someone else answers the phone; (iii) the call goes to voicemail; (iv) the call becomes disconnected; (v) you are not (or do not seem to us to be) in a position to safely and/or lawfully take or remain on the call (for example, if you are or seem to be driving); or (vi) you are not audible or intelligible or we are not able to conduct a conversation with you in a manner that is suitable for broadcast for any reason beyond our control (including, but not limited to: low/no signal on your device, a call is dropped by any network, you are travelling, there is too much background noise or feedback, etc.); before or during the Promotion, you may be disqualified and we reserve the right to select another entrant to participate in the Promotion or withdraw the prize and select another winner, as applicable. 

8. We and the Promotion Partner may publish and publicise your name, image, social media handle and/or profile picture, your nearest geographical location (for example, your nearest city, town or county) and your entry, and we may refer to your association with the Promotion and/or the prize, in any and all media, worldwide, in perpetuity, for publicity and PR purposes solely in connection with the Promotion. 

9. In relation to winners, you understand that we and our Promotion Partner may: (i) interview you and your guests which we may film, photograph and/or record and; (ii) film, photograph and/or record, you and your guest(s)/travel companion(s) in connection with the Promotion, either by telephone or in person, and we may use such films, recordings and/or photographs for publicity and PR purposes in any and all media, worldwide, as often and for as long as we consider appropriate or desirable, in connection with the Promotion. We may also publish your and your guest(s)/travel companion(s) name, image, social media handle and/or profile picture.

Eligibility:

10. The Promotion is only open to residents of Great Britain aged 18 and over, and who are based in Great Britain at the time of entry. For the avoidance of doubt, the Promotion is not open to residents of Northern Ireland, The Isle of Man or The Channel Islands.

Prize specific terms: 

11. CAR 1: One winning entrant will receive a Fiat 500 hatchback 1.0 Mild Hybrid Lounge 3 door in Bossa Nova White. The registration plate number is 70 and was registered on 30/10/2020. The Fiat 500 has a manual gear box and a petrol fuel tank. 

12. CAR 2: One winning entrant will receive a Ford Fiesta 1.0 EcoBoost Hybrid MHEV 155 Titanium X 5 door in Frozen White. The registration plate number is 70 and was registered on 31/10/2020. The Ford Fiesta EcoBoost Hybrid has a manual gear box and a petrol fuel tank. 

13. CAR 3: One winning entrant will receive a Hyundai i10 1.2 MPi SE Connect 5 door Auto in Polar White. The registration plate number is 70 and was registered on 25/09/2020. The Hyundai i10 has an automatic gear box and a petrol fuel tank. 

14. CAR 4: One winning entrant will receive a Toyota Aygo 1.0 VVT-I X-Trend 5 door in Electro Grey. The registration plate number is 70 and was registered on 01/09/2020. The Toyota Aygo has manual gear box and a petrol fuel tank. 

15. CAR 5: One winning entrant will receive a Nissan Juke 1.0 DiG-T 114 Tekna+ 5 door in Blade Silver. The registration plate number is 21 and was registered on 31/03/2021. The Nissan Juke has a manual gear box and a petrol fuel tank. 

16. For the avoidance of doubt, petrol, MOT and car insurance are not included in the prize. It will be the winner’s responsibility to obtain their own insurance for the vehicle. If the prize is to be collected by the winner from their local dealership and driven on a public highway/road, insurance cover must be obtained by the winner prior to collection of the Prize. 17. For the avoidance of doubt, road tax will not be included in the prize. £170 will be transferred to the winner to cover up to one years’ worth of road tax. The winner will thereafter be able to tax their vehicle via the DVLA website, upon receiving the 12 digit V5 number which will be sent to them upon receipt of the car.

18. We will endeavour to transfer the prize money to your bank account within 28 days but are not responsible for any delays. You must provide all necessary details via the method directed within 14 days after the original request to do so otherwise the prize money will be forfeited at our discretion.

19. The images shown of the vehicles on online pages connected with the Promotion are for illustrative purposes only and do not depict an exact image of the prize car available to be won.

20.  All the cars will be covered in a red removable ‘wrap’ for the duration of the Heart Breakfast Roadtrip. The wrap will be removed by specialists and the car will go through Motorpoint’s Quality Standard checks, details of which can be found here https://www.motorpoint.co.uk/motorpoint-quality-standard, prior to delivery at the winner’s location.

23. The car is described as ‘nearly new’, meaning it will begin the week of the Heart Breakfast Roadtrip with less than 1,000 miles on the meter. Exact miles upon delivery to the winner cannot be guaranteed. 

22. All cars will be driven as part of the Heart Breakfast Roadtrip. The route of each car is outlined below. Please note that the Heart Breakfast Roadtrip route may not necessarily be the most direct between each location. Detours will be made in order to visit locations en route. Additional mileage may occur through the Motorpoint Quality Standard, car wrap removal and delivery to the winner’s location.

Car 1 will be driven: Glasgow

Car 2 will be driven: Glasgow – Newcastle

Car 3 will be driven: Glasgow – Newcastle – Manchester

Car 4 will be driven: Glasgow – Newcastle – Manchester – Cardiff 

Car 5 will be driven: Glasgow – Newcastle – Manchester – Cardiff – London 

23. Cars are either available to be picked up from a local dealership or can be delivered to the winner’s address, providing it is in Mainland UK only. The car will be delivered within 28 days from the end of the Heart Breakfast Roadtrip.

25. Maintenance, services and running costs of the vehicle are the responsibility of the winner from the date of ownership. This date will be confirmed with the winner in writing following winner acknowledgement of the prize. 

26. Any other costs and expenses which are not specifically included in the prize description are excluded and will be the sole responsibility of the winner. By way of example, without limitation, fuel and insurance are not included within the prize.

27. If a winner elects to collect their prize from a local dealership, they must show proof of a full valid UK driving license.

28. Registration is included and will be arranged upon delivery of the car.

29. Specification is taken from manufacturer database; exact specification may vary depending on factors outside of Motorpoint’s control. Motorpoint accept no liability for changes, alternations or inconsistencies in manufacturer data.

30. The prize is non-transferable, non-refundable and there is no cash alternative.

31. We reserve the right to substitute the prize with another prize of equal or greater value at our absolute discretion.

33. Your personal data, will be collected and processed by us, our licensees (including Communicorp UK Limited), as well as the prize providers, and if applicable, our service providers, network operators and suppliers in order to administer and fulfil the Promotion. Your personal data may also be disclosed to the Phone-paid Services Authority, Ofcom and/or the Advertising Standards Authority at their reasonable request for regulatory purposes, for example, in order to prevent, investigate and detect crime, fraud or anti-social behaviour and comply with law enforcement agencies and applicable advertising codes. 

34. We may hold your personal data for a period of 3 years in order to comply with our regulatory obligations. 

35. We and the prize providers may transfer and process personal data outside of the EEA and UK for the purposes of administering the Promotion.

36. By entering a Promotion, you acknowledge that any personal data provided by you in connection with the Promotion will be processed as set out above and in accordance with our Privacy Policy, which sets out full details of how we process personal data and how you can exercise your rights as a data subject. Please ensure you have read and understood our Privacy Policy before entering any Promotion.

37. You may request the removal of your personal details from our database by contacting privacy@global.com. If you request that your personal details be removed prior to the conclusion of a Promotion, you will forfeit your right to enter the Promotion and/or claim any prize and we reserve the right to select another entrant to participate in the Promotion or withdraw the prize and select another winner, as applicable.

38. If you are required to submit a guest(s)/travel companion(s) personal data to enter a Promotion, you must ensure that your guest(s)/travel companion(s) have given you consent to provide us with their personal data.
