TERMS AND CONDITIONS for “Old el Paso x Hits Radio (national), Gem, Free, Clyde and Pulse Giveaway” #WINFAJITAFRIDAYS COMP

These terms should be read with our general competition terms which also apply to this Competition. Where there is any conflict between the Bauer General competition terms and conditions and these specific competition terms and conditions, these terms and conditions shall apply.

COMPETITION MECHANIC AND HOW TO WIN The prize winners and grand prize winner will be selected from those persons who submit a valid entry (the “Entrants”). In order to submit a valid entry, you must:

1. Have a public Instagram account and post a picture on your main grid using the hashtag #WinFajitaFridays and mentioning in the description the person you want to spend Fajita Friday with and why; and

1. post the picture within the allocated time detailed in section 3.

We reserve the right to invalidate any entries that include images that are deemed harmful, offensive or inappropriate in our sole discretion.

At the end of each week of the Competition, one prize winner will be chosen by an independent panel consisting of production and marketing teams. The prize winners will each win a £50 cash prize and 4 Old El Paso Fajita Kits and their photo may be posted on Old El Paso’s and HITS RADIO’s (Hits Radio (national), Gem, Free, Clyde and Pulse) Instagram accounts. The prize winners will be chosen on the basis of how original, entertaining, heart-warming and relevant to the brief of the Competition their entry is. At the end of the 7-week period, a grand prize winner will be chosen on the basis of best post from the 7 prize winners by the independent panel and will win a £1,000 cash prize. Their photo may be posted on Old El Paso’s and HITS RADIO’s (Hits Radio (national), Gem, Free, Clyde and Pulse) Instagram accounts.

Entrants must have a publicly available Instagram account to enter. Any private accounts will not be eligible. Any entries posted on Instagram stories will not be valid.

2. ENTRY PLATFORMS AND COSTS

Free entry on Instagram.

3. DATES

Start Date and End Date.

From 00:01am Mon 27th September 2021 (the “Start Date”) to 23:59 Sunday 14st November 2021 (the “End Date”).

Entries received before the Start Date or after the End Date will be invalid.

Winner Announcement.

The prize winners will be contacted directly through Instagram each Wednesday of the following week they have submitted their entry to be informed that their photo has been selected.

The grand prize winner will be contacted directly through Instagram by Monday 29th November 2021 to be informed that their photo has been selected.

All prize winners and the grand prize winner will receive their cash prize by Tuesday 30th November 2021.

They will be given a date by which they must contact @hitsradiouk through direct messages on Instagram and provide them with their full name, proof of address and bank account details in order to redeem their prize. If they do not contact HITS RADIO within this time period they will forfeit the prize.

4. ENTRY RESTRICTIONS

• Open to UK residents aged 16 years or over on date of entry.

• Our employees (and their family members) or employees of any company involved in the Competition, incl. the Prize Provider, must not enter

• Entrants may only enter the competition once.

5. THE PRIZE

There will be 7 x prize winners in total and 1 x grand prize winner who will be chosen, on the basis of best post as describe above, from the 7 prize winners.

Each prize winner will win a £50 cash prize and 4 Old El Paso Fajita Kits. The 1 grand prize winner will win a £1,000 cash prize.

Prizes are non-transferable, non-refundable and no cash alternative will be offered.

OTHER CONDITIONS

1. DATA PROTECTION.

Names, email addresses, and /or telephone numbers (which, for all SMS competitions, will be shared with our SMS provider,) will be collected and used to process entries. The details of the prize winners and the grand prize winner may be given to the prize provider to arrange delivery of the prize. Your details may remain stored after the End Date but will not be used for marketing unless you have ticked an opt-in box on entry or text STOP if entering via SMS. If you have, your details will be used in accordance with the information given when you ticked the opt-in box and gave your consent. For more details, see: http://www.bauerdatapromise.co.uk/.

2. INTELLECTUAL PROPERTY AND CONSENTS.

By entering this Competition, you are consenting to our use of your entry both to publicise this Competition, our radio station or any other radio station which we own or control. This means that we may use all names, images, descriptions, photographs video footage, and other information, which you’ve submitted on entry, in any media, without paying you and without any time restriction. You also agree that we may film, record or photograph you in connection with the competition and /or the Prize (if you win!). We will own these films, recordings or photographs and we may use them publicly, including on the internet, for our radio broadcasts and/or for any promotional purposes. You will also have waived any moral rights or right to payment that you may have had.

Upon entering the competition, Entrants also consent to Old El Paso and HITS RADIO (Hits Radio (national), Gem, Free, Clyde and Pulse) using the content of their entry, including their submitted image, to share on the Old El Paso Social and HITS RADIO (Hits Radio (national), Gem, Free, Clyde and Pulse) accounts on Instagram.

Entrants warrant that they are the person in the photograph of their entry and/or they have prior consent from all persons in the photograph to submit it as part of their entry (or the consent of a parent or legal guardian for any persons under 18 in the photograph).

3. MISCELLANEOUS.

a) Entries that don’t comply with these terms won’t be accepted and you may be disqualified if we think you’ve breached them.

b) One entry per person.

c) If there is a dispute about the operation of the Competition or correctness of any answers given, our decision is final and no discussion will be entered into on this subject.

d) You are responsible for any costs of entry.

e) You may be disqualified if we deem your entry inappropriate, profane, indecent, harmful or offensive. This will be judged in our sole discretion. Any prize already won may be withdrawn and re-awarded to another entrant.

f) We may cancel / amend / end / suspend the Competition if we need to do so due to circumstances outside our control.
