Intestate

Options
Father died intestate. Estate to be split between 4 siblings. Brother (the administrator and currently living in the house no children) wants to buy out 2 shares the third remaining with other sibling (I'm not sure if this is right terminology as I understand as there's no will no one owns the property just a share in its saleable value). He says he has the money to buy the shares but I'm sceptical as to where the money is coming from as it will not be mortgaged do I have the right to know. Is there a website I can quote if I'm can 

Also as the estate is intestate can I insist that the property is sold on the open market instead without brother being difficult and refusing to move out.

This may seem harsh but in previous Post I mentioned sibling who had passed away im concerned brother will do whatever he can to stop or delay distribution to extend his occupation of the property despite being administrator so siblings family are struggling longer than necessary.

Now I know this is being greedy for info but if brother fails to sell/ buy/leave property can we/I charge him rent.

    As beneficiary of the estate I believe you can insist on there being a market valuation to ensure you are getting a fair split.  Obviously your brother can't say "I think the house is worth £9k there you get £3k" when if on the open marktet it would be worth £10million.

    What is the concern about where he gets the ££?  Are you concerned about it being profit from criminal activity?  (which is obviously something to be concerned about)

    And why would he be buying out 2 portions but not the 3rd?  Is he trying to do the siblings family out of their share??

  • 3rd sibling for some reason wants to keep her 'share'. Concern where he gets money from is he says there no insurance but dad said there was - he's using a personal bank account to deal with the estate not saying he wd con us but where theres money there's greed he's a delivery driver not a good wage. Just so you know I wd have been so much happier if dad had signed his will id have received nothing & this feeling of distrust wd all be over.
  • The solicitor dealing with the transfer wont do so without checking the source of the finance. They have to do this to comply with money laundering legislation.

    if you are concerned about his valuation there is nothing stopping getting your own independent valuation.
