Civil Enforcement -My Appeal has been Unsuccessful

We have received a parking fine from Civil Enforcement ltd. for £100.00 or pay £60 if paid within 14 days.  I appealed immediately stating there was no evidence (ie.photo) of our vehicle which is actually registered in my husbands name, as per the forums suggestion.  Now I have received this letter stating i either pay or appeal to POPLA as I have been unsuccessful in my appeal.
Do i have any realistic chance of making this fine go away or do I just accept I parked and pay up? any advice would be very much appreciated.

What happened when you tried PLAN A in the NEWBIES thread first?

We have no idea what the alleged contravention is and what type of car park do impossible to advise if you will win at POPLA without further info please and what the landowner said when you complained.

We assume the appeal was done not by you but in the name of the keeper?  The forum doesn't suggest appealing saying there aren't any photos so what appeal did you use?

  • Thank you for responding.  Sorry for the delay in coming back.  The carpark is owned by the hotel & pub.  I admit I didn't visit the pub as my daughter drove in and waited in the car while I went over the road to the post office.  I haven't been back to complain.  i sent the letter suggested in the newbie thread saying appeal by the name of the keeper.  I assume this isn't correct as they then rejected my appeal! what do i do next or do i accept a fine of £60 as an expensive mistake?

oif course they rejected it, there is no profit in acceptance !! they just want your money

you shoud have received a POPLA code with the rejection, if so appeal to POPLA (in the husbands name if he is the RK )

see the third post in the newbies FAQ sticky thread near the top of this forum, in announcements

all the stages are explained in that thread

Not sure why you assumed the first appeal would work?  The NEWBIES thread tells you about POPLA stage.

You do not have a "Fine" you obviously aren't getting this.
  • Okay - sorry 'Fine' was the wrong terminology! it is a parking charge. I have looked on the popla appeal thread as Civil Enforcement has given me a POPLA verification code.  One of the points for an appeal to Popla was that parking signs were not prominent, this is not the case for where I parked. not sure what grounds to appeal now as don't fully understand which course i take.

When you received the PCN , clearly your reaction was to not pay it !!

So what was that reason ?  That is the reason for appealing to CEL instead of paying

A popla appeal can only win on a technicality , so you appeal using technicalities , because nothing else will win, these are all those technicalities ( or certainly most of them )

    POFA 2012
    CRA 2015
BPA CoP version 8 dated January 2020
    No landowner authority
Completed court cases like Beavis and Jopson etc
Poor and inadequate signage ( including poor lighting )
    Paperwork errors
    Anpr or Mnpr misreads

So please take your pick , or use most or all

Appealing is for when you have a good case , not just to avoid paying , so think of the case you decided was the reason to take these actions of appealing and avoidance

You STILL haven't said why you got the charge was it for leaving site, not putting a vrn in a terminal, not paying, how long were you there are grace periods applicable?
The photo argument is unlikely to wash with POPLA but you can still put it in. The BPA COP states:

21.5a When issuing a parking charge notice you may use
photographs as evidence that a vehicle was parked in an

    unauthorised way.

Use POPLA and throw the items that Red has listed.
