Parking Fine on Lease Car

Hi  Back in 2017 I received a fine from VCS for a parking offence at John Lennon Airport. I was informed that because I had not paid the initial fine that the fine had increased to £160 (doubled)   I contacted them explained that I had never received the notice so had never been afforded the opportunity to pay the initial fine. I suggested that this may be due to the fact that it was a privately leased car and the notice would have been sent to the Registered Owner. After several weeks on the issue being placed on hold I was contacted again to say that was in fact the case but I still had to pay the £160. I refused and I repeated my earlier statement about the initial notice. 4 years later I have now received a letter from ELMS LEGAL threatening leal and CCJ actions. Has anyone else had a similar experience or advice please?

    Plenty of people have had warning letters about various airport parking charge notices , including about JLA !

    VCS have issued quite a few court claims

    If you were the lessee , they were given your details as lessee or hirer ( keeper ) and will assume that you were driving

    It's not a fine , it's an invoice

    This is nothing to do with ownership , there is no such thing as a registered owner

    It is neither a fine, nor is ir an offence, please read the newbies.  

    They have added what appears to be an extra unlawful amount OF £60 for debt collection. Judges have dismissed an entire claim because of this. Read this and complain to your MP.

    Excel v Wilkinson


    At the Bradford County Court, District Judge Claire Jackson (now HHJ Jackson, a Specialist Civil Circuit Judge) decided to hear a 'test case' a few months ago, where £60 had been added to a parking charge despite Judges up and down the country repeatedly disallowing that sum and warning parking firms not to waste court time with such spurious claims.   That case was Excel v Wilkinson: G4QZ465V, heard in July 2020 and leave to appeal was refused and that route was not pursued.  The Judge concluded that such claims are proceedings with 'an improper collateral purpose'.   This Judge - and others who have since copied her words and struck dozens of cases out in late 2020 and into 2021 - went into significant detail and concluded that parking operators (such as this Claimant) are seeking to circumvent CPR 27.14 as well as breaching the Consumer Rights Act 2015.   DJ Hickinbottom has recently struck more cases out in that court area, stating: ''I find that striking out this claim is the only appropriate manner in which the disapproval of the court can be shown''.

    No, you shouldn't be paying anything at all and it isn't a fine.  

    Have you missed all the dozens of other VCS Airport threads, all won?

    Also missed the NEWBIES thread 2nd post about LBC stage snd how to win in court?  If that is due to using a phone, get on a laptop snd read the forum properly, including all the exact same VCS Airport threads as yours.  All won, like I ssid.
