I'm not sure in this case I need consent from the claimant because it is a court error.
No way BW legal will answer anything I send in regards of consent anyway. I sent them an email 2 weeks ago and have had no reply.

It won't hurt to ask for consent even if it was the court's mistake. The claimant would appear to be unreasonable if they refused.

The court can decide to deal with it without a hearing (which makes sense for this case) so I hope the local court only charged you £108?

Hello all, I received this email from the complaint department this morning, seems to be good news that they have admitted the mix up in writing now. Just have to wait until I hear more now I guess. 

Nothing about the outstanding CJJ though. I guess the judge will overturn that with a new order or hearing.

I am the Civil Team Leader and I am writing in response to your complaint.

 

I've checked all the details of your complaint for you, and I apologise that you have had to make this complaint. 

I've looked into the case and I can see that on 06 July 2022 our listing team contacted you by email to advise that the hearing was adjourned due to the Court being unable to secure a Judge to hear the case. 

I can also see that on 30 July 2022 the Court sent the Order made by Deputy District Judge Willink dated 07 July 2022.  The Court referred the matter to a Judge on 24 August 2022 as there has been a clear error in this case and no Order should have been made. 

On 30 August 2022 the Court sent the Order made by Deputy District Judge Le Bas and following this, the Court re-referred this back to a Judge after receiving your response to the Order. 

 

Unfortunately, I cannot provide an explanation as to why the Judge made an Order on this case as the hearing was adjourned, it could possibly be that the Judge still had the file even though the Court adjourned the hearing.

It is clear that there has been an error in the order being made however due to a Judge making an order, the Court requires approval from a Judge to make a further order. 

 

The Court has referred the matter back to a Judge urgently for directions and as soon as it has returned, the Court will inform you of any further directions.

Just a quick catch up. I have my hearing tomorrow so I have just done a quick crib sheet to take with, me tomorrow. Along with my bundle. Its quite basic, but if anyone can let me know what you think. Would be great thanks.

1. The witness Kimberley Kaddra appears to not exist, and is not here to be questioned. a) Is Kimberley Kaddra present? b) How long has she worked at BW? This happened in 2017 so is a false statement if she signed this, and did not work for them. 

1. 1)The claimant has wasted time with a poorly put original poc, which meant case was unnecessarily stayed 

2) They failed to supply any detail or photo evidence at pre action stage, 

3) Their WS uses accusing and aggressive language regarding the details in my WS. I have received advice and help, why would I not? To be made to feel like this is a terrible thing to do  as a very ‘green’ litigant in person is totally unjust. 

4) When the mix up in the CCJ 23.08.22 happened.  I knowing an error had occurred was desperately trying to sort it out.  I contacted Bw Legal KKaddra, Premier Park, explaining the situation. I received no reply. Apart from 2 letters from BW Legal which I have with me, talking the outstanding CCJ, about Bailiffs and my balance increasing in a very forceful manner. These were sent out after I contacted them to halt everything because of the clerical error by the court.

I BELIEVE ALL OF THESE POINTS POINT TO A WHOLLY UNREASONABLE COURSE OF CONDUCT BY THE CLAIMANT.
