DPD truck hits a tree, branch falls and damages my car.

Last friday night, a DPD high trailer going through a B road hit a tree and a branch broke off, it came down hard, hit my car and damaged it smashing the windscreen. Insurance tells me they cant claim from DPD???

    These things happen,, no one at fault, no one to blame, which is why you have insurance cover yourself.

    Will the OP have to declare it as an at fault claim in future insurance applications?

    I'd guess that it could be considered negligence by the DPD driver but rather hard to prove so the insurance co doesn't think it worth pursuing.
    I need to think of something new here...

  • Why would it matter if your insurers can make a claim from DPD or not? 

    If you’re fully comp, they have to repair your damage. If you’re third party, you’re on your own anyway.

    Not sure why some people say the DPD driver may not be liable? He negligently drove into a tree causing part of it to fall in the OP’s car causing damage. If it weren’t for the impact between the tree and the van, there would have been no damage.

    Was the damage just the windscreen?
    Could be a glass claim only.
