Returns to Matalan without label

Hi

bought some clothing at matalan - unfortunately labels taken off and lost :( but I have the online order receipt.

what are my rights to return these please ? Clothing totally unworn and unused .


another item I bought in store , again no label but lost receipt :( again what are my rights ? Thanks

  • For the store bought item no right to change of mind return, even if it still had its label., for the on line purchases, it depends on when your bought them, but as you have lost the labels It does not sound a recent purchase so you are probably beyond the 14 day cooling off period.

    Its actually less than 14 days :( but during spring clearout at home lost the labels :(

    Why would you taker the labels off? 

    From what I hear it's a common mistake people make.. sometimes people wear an item once and then return them so the retqailer may be suspicous about the return.

    I disagree.
    Whilst it's certainly correct that there is no statutory right to a change of mind return for store bought goods, this doesn't mean that there is no contractual right of return.

    As Matalan's T&C's state that such returns are allowed:

    Returns Policy

    Changed your mind? Don’t worry, you can return items in store, by post or via our online portal.

    We’ll be happy to exchange or refund within 14 days of purchase if you bought the items in store, or within 14 days of you receiving the items if you ordered them online. Items must be returned with the original receipt, unworn and in the condition they were purchased, including all packaging. The refund will be issued on the method of payment you used.


    then this policy forms part of the contract of sale and as such, provided a return is requested within 14 days and the item meets their requirements (undamaged, unworn, labels attached etc) then legally Matalan can't refuse to accept that return.
  • With no labels you’ve got no chance - sorry.
    Matalan and most others are very strict on this.

    Any retailer is going to be suspicious of returns if the labels have been removed.  If the label had been 'lost' from one item it might be accepted that it was pulled off by accident - when all have been removed it's no accident.

    Bottom line; yes you can return them as they are an online purchase and you're within your 14 days cancellation period but the seller can deduct an amount, up to the full cost of the item, from any refund if the goods have been handled beyond what is necessary to determine their functioning etc. As you've removed the tags than this has gone beyond the sort of thing you can do to determine the fit and functioning of the clothes and therefore your chance of any refund is pretty minimal.
