POPLA rejected appeal for registration error

Hi, I've looked through previous posts and there is so much to digest so apologies for another parking ticket discussion but was hoping for some guidance please.

I use the same Premier Park Ltd car park most weeks and purchase a ticket which involves putting my registration in a machine.

I had a fine sent through due to none payment one Sunday, but when I checked the ticket I had purchased for that day, I noticed  the 1st 2 digits of my registration were missing. I appealed the fine sending evidence of purchasing a ticket, and then again via POPLA thinking common sense would win but have been rejected all the way. Premier Park are now expecting me to pay £100 but I don't see why I should as I bought a ticket for the car I parked.

I have since seen that according to BPA registration errors like this shouldn't be issued with a fine.

Is there any point in trying to make Premier Park or POPLA review this again?
Can I ignore future letters demanding payment?

Thank you.

    It's not a fine , it's a parking charge notice , PCN , an Invoice

No private parking company can fine you !

But as for keying errors , download the BPA CoP version 8 dated January 2020 , reading the section on keying errors

Did PP offer the £20 option ? Yes or no ?

If no , report them to the BPA AOS team online , using the complaints firm

Neither is likely to review it again , so complain about it to the BPA AOS team and also complain about it by email to your local MP too !

You should check that you used the BPA CoP clause , or appealed about the keying error correctly , if yes email a procedural complaint to the senior person Jogphn Gallagher about that particular point , no ranting , clear , concise and clinical

Anyone can ignore letters , unless they are important ones , the newbies FAQ sticky thread near the top of the forum in announcements tells you how to differentiate between them , post 4 is the ignore ones , post 2 is the do not ignore ones

PP are likely to issue a court claim pack from the CCBC in Northampton within 6 years if you don't pay , but a judge would be more sympathetic to your case , especially if it's a simple human error or a machine error

The system is changing next summer and keying errors will feature in the new government CoP

Why should you pay for an error of their PDT?  How was the ticket able to be issued if the car with the VRM that you typed or the PDT "thought" you did, was not in the car park.  Smells like a honey trap or bear pit!

Which is a part of the defence if it gets to court !!

It's also why there is a section in the CoP about major and minor keying errors , and will be in the new CoP next year too

The biggest error that Helen made is not coming here first. , Back at the start , for advice and hand holding 🤔🤔😭😭
  • I really should have come here first. Very naive of me to think that they would see the simple error and take it all back.
Appreciate your help and I will be putting complaints in as suggested.

Many judges are reluctant to find for BOC in these circumastance, they regard the matter as trivial and a waste of court time.  Any PPC appearing in front of one such judge is likely to be givem very short shrift, read this and comlain to yoyr MP

  • Hello. All complaints failed to override the appeal decision and I have now received a Gladstone letter on behalf of Parking Eye giving me 30 days to pay or to go online to complete a form. After reading the newbie thread am I right that the next step is to ask parking eye for all data they hold on me and to inform Gladstone thats what I have done?
Do I need to register anything online as requested by Gladstone?
    Thank you.

You do not have to complete any forms (unless it is a N1 claim form from Northampton CCBC) but send them a 30-day hold letter whilst you seek debt advice - this is all written out for you in the NEWBIE sticky second post.

Eh?  ParkingEye would go nowhere near Gladstones to issue letters on their behalf in the lead up to legal proceedings!  Please check your paperwork.

I think PE would be mortified to see their name and Gs in the same sentence! 😝
