Not parked

I recently had a notice from future-park and a photo of my car in an hotel car park. The firm is private. It said I had parked on the car park for  hours. I didn’t. I was dropped off to work as my partner wanted to use my car, using the car park as a pull in and pull off . Six hours later I was picked up again on the car park. Total time  was 2 minutes on the car park. I work next door to this car park and have my own free car park to use for work when I have my car so I have never parked to pay. I have appealed as I have proof my car was elsewhere for the 6 hours but I was wondering why they lied and said it had been parked up for 6 hours when it wasn’t. I’m not paying anyway as what they said happened - didn’t!

Hello and welcome to the parking board.

Is the parking company Future Parking Limited?

Look up double dipping , as explained on the parking prankster website , 2 short visits clocked by anpr cameras , In out , In out , middle 2 missing , so they calculated first in to last out , a typical mistake because only 80% accuracy for anpr cameras !!

Not lying , but definitely mistaken

Check if the vehicle can be proven to be elsewhere within that period , or check dashcam footage , anything to prove that it wasn't there all day

It's only 50% accuracy where a double dip occurs.  ;)

    Because,

    1) They are a completely unregulated company operating in a completely unregulated industry.
    2) They are greedy and want your money
    3) They deliberately use ANPR that is prohibited for use in council car parks by the UK Government because it is not fit for purpose but the faults it generates allows them to make money.

You should complain to the landowner, the BPA (assuming the PPC is Future Parking Limited), your MP, the DVLA, and the ICO that your personal data has been requested, released, and processed without reason.

You should also send an SAR to the PPC as advised in the NEWBIES and specifically ask for all four images of the car: In - Out 1 and In - Out 2.
Complain to the ICO if they fail to supply all four.

Please explain what you mean about your normal parking arrangements when you use your own car. Do you mean you park elsewhere, in which case why didn't the driver do that this time, or do you mean you have permission to park where the alleged event occurred?

  • Where I work is behind the hotel so as I wasn’t parking it was easy for the driver to pull in and drop me off. I’ve worked around there for years and have never had any need to park on the paid car park. The picture of my car shows lights on the rear as it was not parked in any bay.

I suggest in future you do not use this car park again. Avoidance of a PCN is better than having to fight one.

This is a very well known ANPR flaw, as the links and advice show. A scam, really, because it's something PPCs are meant to pick up with manual checks.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
CLICK at the top or bottom of any page where it says:
Home»Motoring»Parking Tickets Fines & Parking - read the NEWBIES THREAD
  • As well as following the excellent advice to get the PCN cancelled, I would consider sending a letter saying please stop harassing me - I do not owe you money because …….

Obtain free proof of postage (do not ask for them to sign on receipt).  Every time you get a new demand, send another letter.

Judges do not seem to award costs in the majority of cases - but the breach of GDPR is an important point that is often overlooked which is why I submitted a separate claim. Article 82 says you do not have to have suffered financial loss - stress and anxiety is sufficient.

This outfit had no right to request your personal details from the DVLA.  In the third letter 😎I would also ask where they are storing your personal data - the letters you send will be hard copies (that they cannot claim are held on a secure computer).    Many times the parking operators do not have an actual office (I asked to view my personal data at the registered office) which is against the DVLA requirements and those of the Companies Act - ie the public should have access during office hours.

Then, if they persist, I would send a letter before action asking for £300 for breach of GDPR and harassment.   I see there is a new group action. If I hadn’t already won my case I would have considered joining it (after looking into it thoroughly of course).  I joined a group action in 2018 for a breach of GDPR which has just been settled 😊.  All group actions may not be the same so caution is needed.
