Smart Parking help

Car entered Smart Car park that has two free hours parking then pay at machine if over. Sign at entry stated this and referred to signs in the car park for t&cs.
Driver wasn't sure if over the 2 hours so typed reg into machine but machine just said pay with coins and no I dictation of amount owed.
Driver took photo of ring go notice and left car park so as to avoid £7 charge for overstay of free 2 hours in case it was still in the limit.
Driver pulled up outside of car park and rang company number first but closed, then the ring go number but again it just asks how much you want to pay. Then driver downloaded the ring go app but same situation, no indication of timings. (apnr cameras in operation at car park).
Driver returned to car park by foot to double check signage.
Entry sign states first 2 hours free. For additional time purchase a parking ticket for the duration of your stay from the payment machine.
Within the car park there are smaller signs that say take note of the time of arrival but not on entry.
I have contacted site owner and waiting for reply.
Any thoughts?
Can the driver still just pay the £7 for 3 hours in case it may have gone just over or will a fine still be issued as car already left car park?
Doesn't seem a fair system to me that a machine saying 'pay in coins' without giving an amount could indicate that you owe nothing.

None of this matters. It's Smart. Beaten with one email appeal. Easy one.

Thank you.
What grounds would it win out of interest?0 -
Has a Parking Charge Notice been issued yet?
If so, the keeper should send the blue text template appeal easily found in the first post of the NEWBIES thread.
Send it unchanged.
There will be no fine.
Fair?? What's that got to do with it?DwayneDibbley said:Doesn't seem a fair system to me...
Welcome to the shady world of private parking.

No pcn as event happened today.
Lol, I know the parking game is unfair but this seems unreasonably so in terms of a defence.0 -
As long as you don't go naming the driver and sending your own appeal about the story of what happened, it wins for the reasons explained in the NEWBIES thread where I single out Smart Parking and a couple of others.

Wait for the Notice to Keeper (NtK) arrives through your letterbox, then deal with it, by which time your study of the NEWBIES FAQ Announcement will have you fully prepared to get this cancelled in no time flat. Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

So should I cease the site owner route as I know they are sensitive to the whole new development and local community?Coupon-mad said:As long as you don't go naming the driver and sending your own appeal about the story of what happened, it wins for the reasons explained in the NEWBIES thread where I single out Smart Parking and a couple of others.

Yes just wait for the PCN if not arrived yet, as long as you are sure the DVLA have the right address for you on the car's logbook snd it's not a hire, lease or company car.
England or Scotland?PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
