NTK sent after 3 months NCP

Morning, I’d appreciate some advice please 

My daughter (18) has received 3 NTK PCN’s from NCP for parking in a Railway Station Car Park.

The infringements date from June 2021 and the date of issue of PCN in September 2021.

Rather naively she thought she could park there at night and meet friends. And as no parking tickets came through she has continued to go there over most of the summer!!!

Now, we are thinking there could be potentially 50-60 more tickets on the way, totalling thousands of pounds - which she has no way of paying.

My question is why were they not sent sooner (within 14 days) then obviously she would have paid and not parked there again.

Can we ask NCP just how many more are in the pipeline?

And should these notices have been sent sooner?

    Forget all that , start by reading the newbies FAQ sticky thread near the top of the forum

    As long as the driver is not revealed she has no keeper liability , due to POFA 2012 !!

    Blab about the circumstances and who was driving and she loses a lot of money

    She appeals as keeper using the blue text template from the first post in the newbies FAQ sticky thread near the top of the forum in announcements , no changes , appealing each one separately !

    Read the section on golden tickets , no keeper liability , first , then follow the advice I gave you

    They had 14 days for keeper liability , assuming no windscreen PCN NTD was issued , or 56 days if there was an NTD. So anything over 2 months delay is a godsend

    Otherwise they had 6 months for driver liability

    So they snooze , they lose , if nobody reveals who was driving !!

    You have been warned !

    Yep, hopefully she has learnt her lesson and parks ON STREET in future; pretty much every town and City including London has free side streets to park, outside of permit hours in the evenings.

    TELL HER TO AVOID CAR PARKS WHEN WANTING TO PARK HER CAR, THIS IS BASIC STUFF BUT DRIVING INSTRUCTORS DON'T COVER IT!

    If you have to use a car park, look at the signs at the entrance and go online and deliberately choose a Council one and pay the parking tariff.  AVOID any private firm car park lije the plague.

    As for dealing with and killing off all the PCNs, easy as pie...

    ...but it will take hours of her time for multi PCNs to see them all off.  She is going to have to set aside time and get VERY organised, using a laptop not a phone and appealing EVERY ONE as registered keeper, one by one, and print out (yes print) a screenshot to show the appeals page with PCN ref, and the auto response page to prove that each one has been appealed.

    Then the next, then the next.  Stapling her proof of appeal to each NTK so you are sll certain none were missed.

    The appeal wording is copy and paste, use the template appeal from the NEWBIES thread and add in a line stating that NCP have failed to meet the POFA 2012 deadline/wording and cannot hold the registered keeper liable so must cancel.

    SHE MUST NOT TICK 'DRIVER' ON THE APPEALS PAGE, NOR GIVE HER PHONE NUMBER, NOR REPLY TO ANY BEGGING LETTER ASKING WHO WAS DRIVING 'BEFORE WE CAN MAKE A DECISION'!

    We presume her car is not hired/leased and that NCP got the data from the DVLA not a lease or company keeper?

    We assume she is the registered keeper and the NTKs are in her name.  The above is easy and will win at POPLA.  She needs to take them all to POPLA and repeat the appeal reasons (non POFA, no keeper liability) and win each and every one, which this approach will.

    WARNING: if she loses track snd misses any, or misses her POPLA code deadline (30 days from rejection email/letter) NCP will likely sue. Hence why I say print everything out.  She can pay for the ink!

    Would you suggest she admits to racking up potentially 50-60 tickets in her complaint to her MP?  Just so she knows.

    I don't think this is one for an MP.

    It is one to deal with as keeper, never saying who parked.  All killed off at POPLA but it will need a military organisation which is why printed proof of appeal stapled to each matching PCN is the only way to keep on top of it, IMHO.

    if even one is overlooked and appeal missed, they will sue.  But the good news is that this is a nailed on slam dunk win at POPLA due to it being non POFA, no keeper liability.

    Fabulous news.  Easy when you know how!  Your DD does need a lesson on reading signs in every private car park though (anywhere that's not Council is private land, this isn't a special phrase).  We think driving instructors should tell people.

    Nice outcome.  She should make sure she doesn't get any more by parking a) within the t&cs of the car park or b) elsewhere.
