APCOA Parking Ticket - Train Station

Hello,

I have read a few posts on here and am hoping to get some advice.

I received a final notice of payment two weeks ago from Debt Recovery Plus, stating I owed £170. I had not seen anything prior to this (lost in post or oversight at home) so missed the time to appeal. I found out I was initially issued a parking penalty from APCOA because I had not downloaded the parking app and bought my ticket fast enough according to the time frame in their terms and conditions, which are supposedly listed on signs in the car park. I struggled with downloading the app, jumped on the train, and paid the ticket as quickly as I could. I was caught on camera leaving the car park the following day, which is when they issued the ticket for the mistake I made the day prior.

I have now refused to pay the debt collectors because I knew nothing of the ticket and did not feel like this was a fair case, and APCOA have said all I can do is to wait for the next letter regarding court.

I have read here about steps to follow during an appeal, but unfortunately I’ve missed that boat. I am unsure as to what to expect next, but feel there are enough red flags and holes leading to where I am now, that I could build a case for myself.

    Ignore the debt collector letters ( post 4 ) , debt collectors are powerless

    If you get a formal LBC or a court claim pack from the CCBC in Northampton , come back to this thread after re reading the newbies FAQ sticky thread again ( post 2 )

    Ideally , do not blab about who was driving , not to anyone , so we hope you haven't mentioned it to Apcoa or drpl !

    A keeper has no liability for this PCN , hence why you don't tell them who was driving

    You owe nothing unless a judge says you do.  

    Also, they have added what appears to be an extra unlawful amount for debt collection. Judges have dismissed an entire claim because of this. Read this and complain to your MP.

    Excel v Wilkinson


    At the Bradford County Court, District Judge Claire Jackson (now HHJ Jackson, a Specialist Civil Circuit Judge) decided to hear a 'test case' a few months ago, where £60 had been added to a parking charge despite Judges up and down the country repeatedly disallowing that sum and warning parking firms not to waste court time with such spurious claims.   That case was Excel v Wilkinson: G4QZ465V, heard in July 2020 and leave to appeal was refused and that route was not pursued.  The Judge concluded that such claims are proceedings with 'an improper collateral purpose'.   This Judge - and others who have since copied her words and struck dozens of cases out in late 2020 and into 2021 - went into significant detail and concluded that parking operators (such as this Claimant) are seeking to circumvent CPR 27.14 as well as breaching the Consumer Rights Act 2015.   DJ Hickinbottom has recently struck more cases out in that court area, stating: ''I find that striking out this claim is the only appropriate manner in which the disapproval of the court can be shown''.

    You can ignore APCOA.  They don't sue anyone and can't hold a registered keeper liable (they don't use the POFA 2012 wording anyway), so no ringing any letter sender up and talking about who was driving!

    Have you not yet read post #4 if the NEWBIES thread about ignoring DRP and Zenith letters, with pictures?  

    Have you not seen the recent pics of their tedious new letter with 'PAY NOW!' stamped in red?  Scary...not!  A couple of recent threads have discussed this silly letter.
