Stamp duty question

Unfortunately we need to move home due to an abusive neighbour that isn't being resolved by mediation or diplomacy.  

We will have the funds to cover the solicitor, estate agent and movers by next Easter however there is likely to be an additional £8,500 for stamp duty for the property of the value we would purchase.  

My question is having never moved (we have been here 21 years), is there a way of releasing the value of stamp duty from the sale price of our existing home with the new mortgage covering the difference between the balance and the price of the new property.  E.g. if the sale price was £268k could we take £8k from this to make a value of £260k then take a mortgage for the difference, e.g. £80k if the new house we wished to purchase was £340k - or are we stuck here until we raise the additional £8k? (taking a loan isn't an option we wish to consider).

    In essence of course.

    But in reality how easy will selling be with a dispute going on, I assume it's on record as well?
  • Our neighbours want us to move, they have told us so as they don't like the way be bring up our children (we don't let them play out and vandalise property unlike their children,  which is 'ok' as they are kids apparently) and that we don't have a a tidy back garden like theirs (that consists of plastic grass and artificial plants).  A small evergreen tree on along the boundary drops leaves occasionally onto their plastic grass and this is big issue...   I would laugh but I've learnt some new swear words and vulgar descriptions about myself and my teenage daughters recently....
