PPS - serviceable address & transfer of liability

Hi, I was wondering if anyone could help me with a reply to this response I received from the parking company. I have provided them already with the drivers name and address, who is now living abroad and this is the response they have sent me.

Any help would be appreciated, thank you.

Please be advised we have been informed the address provided below is not a serviceable address and therefore a transfer of liability cannot be processed.


Please be advised that “current address for service” means
(a)in the case of the keeper, an address which is either—
(i)an address at which documents relating to civil proceedings could properly be served on the person concerned under Civil Procedure Rules; or
(ii)the keeper’s registered address (if there is one); or
(b)in the case of the driver, an address at which the driver for the time being resides or can conveniently be contacted.

As the address you have provided is not serviceable as it is not an address at which documents relating to civil proceedings could properly be served on the person, we cannot transfer the liability for the aforementioned parking charge. Therefore, you can appeal the parking charge based on keeper liability.

    Thank you for your letter dated nnth Month 2021.

    As already advised, the address for the driver is [repeat it again].

    I note your definition of 'current address for service' and confirm that the above address conforms with that definition. Specifically, the supplied address matches sub-paragraph (b) - 'an address where the driver for the time being resides'.

  • Hi. just a follow on from this. Its been 8 weeks today since I've sent the email and apart from the automated response, I haven't heard from them. Is it still the case where I just wait and don't contact them because the balls now in their court?
