Why didn't you see it in the light of your headlights (assuming the road wasn't streetlit)?
MSE's chief victim blamer strikes again!
You may know him from other recent hits such as:
"why didn't you see the speed camera that was covered with foliage"

Why were you speeding in the first place?

    What....?
Oh, I see, you think I was referring to myself re the speeding thing.
Nope, not me, but thanks for helping demonstrate my point:
Here's a few straight off the top of my head in the past wee while:

OP - reversed out of a parking space into someone driving the wrong way down the lane behind me
Forum - WHY DIDN'T YOU SEE THEM

OP - Got done by a speed camera/traffic light camera that's obscured by foilage
Forum - WHY DIDN'T YOU SEE IT - POST PHOTOS SO WE CAN JUDGE YOU

    Now this one today.
WHY DIDN'T YOU SEE THE STONE!!

    It doesn't, really.
It's just the most holier-than-thou, victim-blaming forum I've ever come across.
Surely fault lies with the driver? What % would be all factors from too fast, etc
Can it ever be anything BUT the driver's fault if they drive into a stationary object?

Whose fault will it ever be if you don't drive according to your ability to see?  Get real, sarge.

Back in the real world, I'd just put it down to experience.

Does that mean we should all be driving at 20mph on the motorway at night? After all, if you should only drive at a speed at which you can stop in the distance you can see, 70mph or anything close to it would be inappropriate.

Personally, I don’t think that running into a stationary object is always the fault of the driver, particularly if it is an object that is not reasonable for it it to be there. However, being able to claim is going to require the identification of someone who was negligent and by whose negligence resulted in the object being there and unfortunately, that is likely to be just about impossible.

Save driving at it deliberately, hitting a stationary object is a consequence of not seeing it.  The chances of facing those consequences are higher the faster you drive.  It is your responsibility to fix your own car in these circumstances.  Unless you are going to sue the rock.  Whose responsibility is it to look for any obstructions?  The driver's.  If the driver does not see it, then whose responsibility is paying for repairs?  The drivers.  I see a common theme here.

    Yes...

There have been very occasional cases of people being parked on blind bends etc and being hit and the parked vehicle was deemed partially liable... these tend to be old cases and generally considered superseded.

When doing my training on liability the final test was a case of jobsworth council contractors doing exactly what the job sheet said when cutting back a pavement resulting in some street furniture now being a few feet into the road. Everyone failed the test as we all said the driver was at fault but the judgement given said the council had a minority liability in the case as they've a enhanced duty of care. No idea where the materials are these days to find the case title.

I don't disagree with anyone's assessment that the OP won't be able to blame anyone.
It's this "why didn't you see it" crap I cannot be bothered with.
    Holier-than-thou idiots.

Yes it's a statement of the obvious. But clearly the OP did not realise this as they started a thread on "any compensation avenues"
What happened to personal responsibility for making sure you are up to date with the highway code. Which as many users point out advises.

You should only drive at a speed at which you can stop in the distance you can see

Which has been there since I passed my test back in the 70's

Lets just be thankful it was not someone stood in the road...
