Does that mean we should all be driving at 20mph on the motorway at night? After all, if you should only drive at a speed at which you can stop in the distance you can see, 70mph or anything close to it would be inappropriate.ontheroad1970 said:

Personally, I don’t think that running into a stationary object is always the fault of the driver, particularly if it is an object that is not reasonable for it it to be there. However, being able to claim is going to require the identification of someone who was negligent and by whose negligence resulted in the object being there and unfortunately, that is likely to be just about impossible.Northern Ireland club member No 382 :j1 -
Save driving at it deliberately, hitting a stationary object is a consequence of not seeing it. The chances of facing those consequences are higher the faster you drive. It is your responsibility to fix your own car in these circumstances. Unless you are going to sue the rock. Whose responsibility is it to look for any obstructions? The driver's. If the driver does not see it, then whose responsibility is paying for repairs? The drivers. I see a common theme here.Money_Grabber13579 said:

There have been very occasional cases of people being parked on blind bends etc and being hit and the parked vehicle was deemed partially liable... these tend to be old cases and generally considered superseded.
When doing my training on liability the final test was a case of jobsworth council contractors doing exactly what the job sheet said when cutting back a pavement resulting in some street furniture now being a few feet into the road. Everyone failed the test as we all said the driver was at fault but the judgement given said the council had a minority liability in the case as they've a enhanced duty of care. No idea where the materials are these days to find the case title.0 -

What happened to personal responsibility for making sure you are up to date with the highway code. Which as many users point out advises.

Which has been there since I passed my test back in the 70's
