Parking tickets on private land

Hi,

I have accrued 3x parking "fines" for stopping on private land (for no more than 10-20 minutes per stop while I visited my elderly father.

I have read the guide on MSE (https://www.moneysavingexpert.com/reclaim/private-parking-tickets/) and whilst I am thinking of challenging the "fines", I'm not really sure on what grounds? What constitutes "unfair"? As far as I can tell, there is sufficient signage and I did take a risk, not knowing there would be CCTV cameras ahead to enforce the rules!

Not really sure what the stance is here?

    IIMU that some here roundly denounce that "guide".   Have you read the newbies thread?  Have you complaine to your MP

    As above , ignore the awful mse advice , and read the newbies FAQ sticky thread near the top of the forum in announcements , especially the fifth post and then the first post

    Nobody should be stopping on private property for 20 minutes , you get 5 to 10 minutes at the most

    Unfair is irrelevant , it doesn't feature in these cases , only rules , codes of practice and laws !!

    I doubt that it was monitored by CCTV cameras , more likely anpr cameras

    Which parking company ??

    Why aren't you just stopping on double or single yellows on street, if you are just loading/unloading stuff to a vulnerable person? You don't have to drive into a car park to park a car legitimately for a short stop.

    As long as there is not a loading prohibition on signs, denoted by yellow kerb blips as well, then delivering stuff to adjacent premises is what yellow lines are there for.  Perfectly legal to load/unload and zero chance of a PCN by post, and NEVER £100 even if a Council CEO ticketed you (which could be overturned on appeal anyway).

    Use the street, not private car parks.

  • He lives on a red route double red line property, so it's out of the question. BTW, conceptually there are varying concepts of "private land" - it's a road that is connected to the main road (not a driveway or anything). One COULD interpret the road as "public property" if not for the signs (which don't necessarily show the actual markings of where private vs public lands are)

    "Laws" I can understand, but "codes of practise" and "rules"? Not sure I agree with you there.

    I am not interested if you agree with me or not , after 8 years of experience on here I gave you the facts and my opinion , it's up to you if you take the advice on board or not , it doesn't matter to me what you do after I have thought about your problem and given you my advice or opinion , ignore it if you wish , it won't change it ! Not for you or anyone else

    What does matter is what a judge makes of it , in civil court , where claims for unpaid invoices are settled !

    As for the private property argument , if it's not been adopted by the council then it's private property and the landowner can enforce upon it. In other words , it doesn't have to look like a public road , but they often mimic a public road

    You are correct that poor and inadequate signage may be on your side , it often is , plus no landowner authority too

    The fact that you are visiting someone on a red route does not confer extra rights to you on public roads or private property , hence why you have multiple parking charges. If you don't get them paid or cancelled , expect a court claim pack from the CCBC in Northampton within 6 years

    BPA are/is the trade association of which the PPC will be a member, what name is on the PCN?  Of course if there is a PPC called BPA, my apologies!
