Edf cheque bounced

I've had on going problems with edf.  
On pre payment for gas.  My meter had been taking 70% top up per top up for a debt and shouldn't be taking any.  Edf refused to reimburss. Meter was reset and fine now.  Edf sent out a cheque which bounced just last week and edf said it hasn't bounced. I have conformation from my bank confirming their cheque did bounce.   What are my right now?

    I did email them with the proof but they said cheque was still clearing which is untrue 
  • The cheque edf sent out was for compensation not my top ups
  • What's the reason code given for the check bouncing?
  •  It is Criminal Offence to present cheque which cannot be honored.   You need to send them formal notice without delay, as this is a requirement under the Bills of Exchange Act 1883.   I would write something along the lines of:-

    Dear Sir or Madam,

    Under section 3 of the Bills of Exchange Act 1883 a cheque is defined as an unconditional written instruction by an account holder to their bank instructing payment of a specified sum of money to a named beneficiary. Once a cheque is presented, the person presenting the cheque is confirming to the person receiving the cheque that it will be honored.

    Your cheque no 1234567, from bank account number 123456789, of Any Bank plc, dated 21th September 2021 has not been honored and returned with the reason ‘Payment Stopped’.

    Due to this dishonored cheque EDF is therefore in breach of section 3 of the Bill of Exchange Act 1883.

    If I do not receive full payment from you within 7 days of the date of this letter, I intend to issue proceedings against you in the county court without further notice. This may increase your liability for costs.

    I look forward to your prompt resolution of this issue by the issuance of full payment.
