  • The letter I sent includes return of full deposit I have added the link to my post. I suggest as others have done you do it after you leave. 

    Also consider what you want court could be a year off and in that time the LL might deduct stuff from your deposit. Yes it will need to go through the arbitration system but for me all I actually wanted was my full deposit without hassle so that’s what I agreed to. For me this means not having to go through arbitration and argue every point my LL would have made. Also if I went to court I doubt the costs would include me taking A/L (circ £200) and it would be a year away.

    19/5/19 deposit protected 

    31/8/21 tenancy ended 

    6/9/21 request full deposit from DPS 

    20/9/21 no response sent template letter on shelter’s website asking for full deposit and reasonable offer to avoid court

    21/9/21 1pm spoke to letting agent said I’d happily not claim if I received my deposit back in full. 

    21/9/21 1.30pm received DPS email saying my full deposit was released. 

    Notes
    I had a demanding but not crappy LL. The letting agent was at fault although the LL should have checked. I suspect my LL will want to deduct for something maybe a for speck of dust but the LA will have to deal with this not me. 

    I’m a happy camper. 
    Interesting thank you. I wonder then if I should send it now but put the return of my full deposit as part of the negotiation/offer. Maybe that will stop them from trying to take big deductions in the first place and save me a lot of hassle. It's difficult to predict what they'll try and do

    As grumiofoundation has pointed out, if they try to take more than they can justify just claim it back directly from the scheme where it's protected. Then it's up the the LA/LL to back up their claims. Let the scheme act as arbitrator. Just make sure you have plenty of photos to show you left the place as you found it (and I hope you took plenty of photos when you moved in!).
