CCJ Letter Civil enforcement

Hi all, I have received a private parking fine in September 2020, I have been receiving letters but have ignored every single one until now which is a CCJ dated 15th September 2021 from county court business centre, the total amount of £303.40. I have checked my credit history and the CCJ also appears on there which is a big worry.

I believe I have no grounds to appeal as no contact was made as well as setting it aside which is relatively a high price anyway (£255). I have also spoken to county court today and they have said if you pay it off within one month (15th October 2021), civil enforcement will get to us and we will remove the CCJ as it never existed.

My question is, what is the best way to make a payment and to ensure that they will notify the courts as I do not want a CCJ on my file. I have read the newbie thread but unfortunately could not find anything on there. Any help would be appreciated.

Surely that is a question that you should have asked the court whilst on the phone to them today?

Yet again an example of the mess that arises from ignoring Parking Charge Notices.

When you get a parking charge notice you have 3 choices. You need to make them there and then and deal with it. Do not ignore, it will NOT go away.

1 Ignore the Parking Charge notice and enter a period of uncertainty about when and where it will raise it's ugly head again and with potentially added complications and costs and a future battle that you will have to face to clear the charge and any CCJ's that may have arisen

    2. Pay the charge and forget about it.

    3. Pay the charge under duress  and take a claim out on your timescale and your terms  against the Parking company for recovery of the charge made.

The lesson learned is if you do not want a CCJ on your name then do one of either points 2 or 3 above.

Point 1 is an uncertainty against the CCJ sticking to your name.

    Value your time.

You make the payment and keep pestering the Court until they acknowledge that it's been cleared.

You keep repeating this but refuse to supply any factual evidence to back it up - how many such recovery claims have been made and how many have been successful?  You do a disservice to people coming here for help with your posts.

The court suggested making the payment but civil enforcement will let them know, I expressed my concern over nobody answering their phone lines apart from an automated payment link, which resulted in the staff member saying, there’s no other route

You keep saying what you say yet this forum continues to be populated by people getting into a mess by only considering point 1 as a way forward.

People get into messes because inter alia,  they fail to do any reaerrch, they struggle following simpe instructions, they think that they know better or they were badly advised by the man in the pub.

So that's a NO then, you haven't any evidence to back up your advice and continue to be unhelpful and disruptive to people coming here for help.
  • I haven’t complained to MP, still haven’t paid it, just doing some research before I do, so that I can assure that this active CCJ will be removed if paid within the 30 day timescale. Based on research I’ve done, unfortunately I believe there’s nothing I can do about this since I ignored one too many letters

I refuse to accept the allegation of being disruptive and unhelpful on this forum

I have written to the parking charge operative. I have informed them I have paid without prejudice and will proceed to reclaim at MCOL

I have referred the matter to my MP

I have commenced a MCOL against the parking Charge operative.

I am now fully in control of events.
Unlike the prevailing advice on this forum which is to ignore any charges, risk complications and deal with them at some uncertain and inconvenient  future date.
