    Well, due to being overstressed at work and too much going on at the moment to the point of not being able to cope. I saw it as a kind of security for a few months.

    If your deposit is not protected (have you checked with each scheme? See my post below) you are in a strong position.
    * your landlord cannot evict you (S21 Notice would be invalid), and
    * you can claim the penalty of up to 3 times the deposit any time in the next 7 years

    You would have that security on a rolling contract anyway. Current timescale for your LL to get a possession order from the courts is at least 18 months even if they serve you notice today.

    I have just written to Tenancy deposit  scheme (TDS) to see if my deposit has been ever protected (been with current Rental agency for   approx. 5 years).
    The last AST states it is protected with TDS  but when I used TDS search it comes back as with deposit not found. I will also check with the other 2 schemes. 
    At the moment, just getting all the information together as to my rights as a tenant.

    Thank you for the link, it is a very useful reading. 
    I have done online searches and all result are the same "not found".
    In the AST under paragraph "Tenancy Deposit Protection Prescribed Information, details are given of which scheme, etc. Also states a leaflet "What is the Tenancy Deposit Scheme" has been given to me alongside the AST which I never got. So I guess PI has been served. 
    However, never been given a Deposit Protection Certificate code or Deposit Account Number by my LL.
    Neither I was given any copies of Gas/electrical checks or "a guide to Rent" not to mention "check-in inventory" report.

    In that case any S21 given will be invalid and your LL is unable to evict.

  • Remember to claim 3x your deposit for failure to protect it properly
