  • Good morning,

    I received an acknowledgement of receipt of my defence through the post however have not received a Directions Questionnaire. This morning a copy of completed claimant's questionnaire arrived in the post dated 14 October.

    Should I have received one by now to fill in or have I missed something?

    You have missed something.

    The CCBC sent you a letter, or will send you a letter, saying the Claimant had twenty eight days to consider your Defence.
    What you don't know is when the CCBC sent a copy of your Defence to the Claimant. 
    It follows from that that it is not known when the Claimant has to respond to the CCBC. 
    Further, we don't know what delays there are in the CCBC that means they don't send you a DQ as promptly as you might like.

    Can I suggest that you keep checking your MCOL Claim History and as soon as you see that the CCBC has sent a DQ to you, you are ready to download a DQ, complete it and fire it back to the CCBC, remembering to send a copy to the Claimant of course.
  • MCOL site was down last couple of days. Was only able to login today and Claim History shows nothing about DQ. Only three lines:

    Your acknowledgment of service was submitted on 17/09/2021 at 17:06:29

    Your acknowledgment of service was received on 20/09/2021 at 01:21:29

    Your defence was received on 11/10/2021

    As @KeithP wrote, all perfectly normal.  Your defence is sent to claimant by CCBC and they have 28 days to confirm whether they are going to proceed or not.  If CCBC sent defence same day as they received it (unlikely) and claimant sent it straight back (also unlikely) the earliest you would receive a DQ would be 08/11/21.
