To PAY or NOT to PAY

At the end of the day you will have to decide if you are going to pay your parking charge notice or NOT.

You may more than likely have appealed in the BPA Kangaroo court process and lost. So what next??

Well firstly the Advice from Citizens Advice is not to ignore the Parking Charge it will not go away, and you have no knowledge when it will reappear, often with further costs added.

The advice from Citizens Advice here...
https://www.citizensadvice.org.uk/law-and-courts/parking-tickets/appealing-parking-tickets/stop-being-chased-for-a-parking-ticket/

is.....

You should pay your parking ticket, if you can. If you don’t pay:

  • the cost could go up as you might have to pay court costs – and PCNs are increased by 50% if you don’t pay in time

  • your credit rating could be affected

  • the court could send bailiffs to take your belongings

Contact your nearest Citizens Advice to find out your options if you can’t afford to pay the parking ticket.

Once you pay, you put an End to any further unspecified unknown and post dated action the Parking Company may commence. Write to the Parking company stating that you have paid without Prejudice and that you will now be commencing a Claim against them for Breach of Terms and Conditions of the  parking on their part or whatever reason you have to make your claim.

If you are determined that you have been wronged then simply you put in the Money Claim On Line MCOL against the Parking Company for the claim amount.

YOU are now in control of the events.

Good Luck

I am sorry but no newbie should be doing any of this, certainly not asking the clueless CAB what to do.

To all newbies: if you are reading this thread, instead move on and read the NEWBIES FAQS thread instead, top of this forum (see my signature).

  • More than one opinion is good.

Advising people to not pay without fully explaining an alternative is also terrible advice.

I would agree, and all the alternatives are set out in the NEWBIES thread including PLAN A being to complain to the landowner.

Parking firms hate that...what do you think?

I won’t reply here again as this thread should not be the advice that newbies see.  Sorry to say how this thread looks but to the regulars, this almost sounds almost like a PPC wrote it, because telling people that it's easier to pay then sue (which most people would have no clue or appetite for) is something we've heard PPCs say when they've posted before.

  • What an amusing but silly thing to suggest that I am a parking firm employee.

    Terrible advice imo.
You never know how far you can go until you go too far.

This reminds me of an episode from Blackadder II:

Edmund: Look, there’s no need to panic. Someone in the crew will
know how to steer this thing.

    Rum: The crew, milord?

    Edmund: Yes, the crew.

    Rum: What crew?

Edmund: I was under the impression that it was common maritime practice
for a ship to have a crew.

Rum: Opinion is divided on the subject.

Edmund: Oh, really? [starting to get the picture]

Rum: Yahs. All the other captains say it is; I say it isn’t.

Edmund: Oh, God; Mad as a brush.

I see your signature disclaimer, but yet you refuse to accept that there is more than one way to proceed in these matters.

If a person's case is valid it matters not if they seek redress as a defendant or a claimant.

The claimant route eliminates all procedural timescale unknowns.
A Parking Charge is not going to raise it's ugly head again at some unknown future date, with a parking operator in the driving seat of that claim.

You do not really maintain the upper hand by not paying the charge.

I think Bargpole's advice and views on here carry far more weight than your cobbled together effort!
