Short version: The company lists its "Head Office" as being at 82 Mitchell Street, Glasgow, G1 3NA (a suite of offices), but it has no trade premises at all, and only supplies goods online. The company is actually registered in England (at 12 Victoria Road, Barnsley, South Yorkshire, S70 2BB, the office address of its accountants, Gibson Booth Limited) but the Web site fails "due diligence" because it lacks the information required by the Companies Act 2006 and therefore the company and each of its directors in default are committing criminal offences. Therefore, any legal claims made against the company should be filed in the County Court in England, not the Sheriff Court in Scotland, and served at the registered office in Barnsley.
Long version: Part 6 of The Company, Limited Liability Partnership and Business (Names and Trading Disclosures) Regulations 2015, made under Section 82 of the Companies Act 2006, which requires certain information to be displayed in business communications (including e-mails) and on Web sites. The omission of any of the information required by Part 6 is a criminal offence under Regulation 28, which is committed by the company, and personally by each of the directors of the company in default. The VAT number used by this company is actually issued to a different company, Luna Spas Limited, which has the same directors, and appears to be the company that actually fulfils orders made by customers with Trade Radiators Limited. The registered office address of Luna Spas Limited is 21 Chapel Lane, Costock, Loughborough, Leicestershire, LE12 6UY, which appears to be the same as as the address registered for VAT purposes with with HMRC, although that is recorded as Hall Farm House, Chapel Lane.
Despite being legally obliged to do so within five working days, there was no response to a written enquiry sent to James Charles Herbert Auckland, the company secretary of Trade Radiators Limited, requesting confirmation of the missing information (another offence), and therefore we purchased from another company. These offences have been referred to Trading Standards.
It's up to you whether you purchase anything from this company but, for the reasons listed, we will not.
