Fighting parking fine small claims court

Hi please can someone point me in direction if the template I need to send to dispute parking fine  from parking eye.

Pulled into a car park that appears to be council but turns out half of it belongs to mega bingo and half council to which the meter was out if service  during lockdown everything was shut and trying to get dog into vets in emergency appointment. 

Received a letter ages ago and from quick Google responses got was just ignore it .


Now they have sent letter from small claims court to which I need a letter to send them via there online website service.

To the best of our knowledge we was parked in the council carpark hence why tried to purchase a ticket .

    It sounds like you may have received a County Court Claim Form.

    If so, please tell us the Issue Date on your County Court Claim Form?

    Have you filed an Acknowledgment of Service?
    If so, upon what date did you do so?
    Your MCOL Claim History will have the definitive answer to that.

    Who is the Claimant?

    It is not a fine, please read the newbies. 

    Their signs are pants, read this, include it in yourc defence,  and complain to your MP.

  • Hi thanks for the reply the claimant is parking eye . Date issued was 8th of September but we have only just recieved the letter due to been away . 

    Have registered on the mocl website but just looking for where best to go from there . 

    I have read many pages but everyone says use the templates already created for this matter.

    Please answer all the questions from KeithP. They are specific questions designed to give you specific information and important dates.

    The advice to ignore a parking charge has not been given here since the law changed in 2012.

    Where precisely did this occur? The location may have come up here before.
    When did this occur?
    What happened when you complained to the landowner?


    Use the ready written defence template in the sticky Announcements at the top of the forum. Only amend the relevant parts; usually paragraphs 2 and 3, and show us only the parts you have changed.

    A defence is written in the third person, so use the word defendant, not me, I, myself etcetera.

    With a Claim Issue Date of 8th September, you have until Monday 27th September to file an Acknowledgment of Service but there is nothing to be gained by delaying it. 
    To file an AoS, follow the guidance in the Dropbox file linked from the second post in the NEWBIES thread.

    Having filed an AoS in a timely manner, you have until 4pm on Monday 11th October 2021 to file your Defence.
    That's over three weeks away. Plenty of time to produce a Defence, but please don't leave it to the last minute.
    To create a Defence, and then file a Defence by email, look again at the second post on the NEWBIES thread - immediately following where you found the Acknowledgment of Service instructions.

    As the Claimant is ParkingEye, then the template defence is linked directly from the NEWBIES thread.
    However, the guidance for filing the Defence remains unchanged.

    Don't miss the deadline for filing an Acknowledgment of Service, nor that for filing a Defence.

    Do not try and file a Defence via the MoneyClaimOnline website. Once an Acknowledgment of Service has been filed, the MCOL website should be treated as 'read only'.
