Highview parking fine

Hello

I have received a £60 fine for overstaying a 2hour time limit in a retail park car park.

I was in the car park for 2 hours 25 minutes, however I was not parked over 2 hours. I returned to my car prior to two hours but went to. Drive through McDonald’s which had a long queue. I was of the view that as I was no longer parked I would not get a ticket.

could someone let me know if this would be grounds for an appeal?

    Your appeal is as a keeper using the blue text template from the newbies FAQ sticky thread near the top of the forum in announcements , no keeper liability because Highview Parking fail to comply with POFA , the law

    Plan A is also a good idea , it ALWAYS is

    At no point reveal who was driving !!  No way , not to anyone at all !!

    The royal WE can be used in your complaint to the retail park or McDees or the landowner , plan A

    It's admitted drivers that lose and proves costly

    It is not a fine. Please read the newbies and complain to your MP.

    From what you have  told us, they would, imo, be unwise not to cancel this.  
    You never know how far you can go until you go too far.

    Read any Highview thread and learn from the NEWBIES thread too, why it’s vital not to admit to driving or talk about what happened.

  • Thanks for the replies. So I should just use this template:

    ‘Re PCN number: 

    I dispute your 'parking charge', as the keeper of the vehicle. I deny any liability or contractual agreement and I will be making a complaint about your predatory conduct to your client landowner.

    There will be no admissions as to who was driving and no assumptions can be drawn. Since your PCN is a vague template, I require an explanation of the allegation and your evidence. You must include a close up actual photograph of the sign you contend was at the location on the material date as well as your images of the vehicle.

    If the allegation concerns a PDT machine, the data supplied in response to this appeal must include the record of payments made - showing partial VRNs - and an explanation of the reason for the PCN, because your Notice does not explain it.

    If the allegation involves an alleged overstay of minutes, your evidence must include the actual grace period agreed by the landowner.‘

    The letter sent already includes pictures - so so I amend the template at all or just send as?

    As suggested earlier, the keeper should send the blue text template appeal easily found in the first post of the NEWBIES thread.

    None of that includes the thing that will win though.  Have you read half a dozen Highview threads and realised what to add?

    it really is the easiest one if you just read other Highview threads.  No links - we want you to learn how to use the forum, but use Google for them if the forum search is rubbish.

  • Oh dear, guess I’ve lost then.

    I sent the blue text from Newbies post as directed.

    I’ve read lots of highview posts and all reiterate just don’t say you were driving. I’ve read the first 3 pages of posts and not quite sure what I’ve missed.

    Guess I’ll just wait for the response.

    You’ve not lost. A keeper can’t lose v Highview!

    You can tell POPLA the stuff about no keeper liability if Highview don’t just give up first go.  Which they often do.

    If anyone lost its Highview , because they do not comply with POFA 2012 , the 9 years old law , so a keeper has no liability which means a keeper appeal wins , they will either cancel or ask for driver details or issue a Popla code

    Do not divulge the driver details if they ask , just ignore and await your Popla code , easy to win as keeper at Popla , it's been done hundreds of times before

    Just wanted to update: I won!! Thanks for all the advice. I received the following email today:

    ‘ Dear Sir/Madam,

     

    Thank you for your correspondence relating to your Parking Charge.

     

    Further to your representations, we have investigated your claims and can confirm that your Charge has subsequently been cancelled in full and no further action will be taken.

     

    Please disregard any letters received that predate this email.
