Tower Road, Newquay - PCN received - full day payment had been made, but in 2 seperate payments

Dear All, 

Any help would be appreciated.

Please see attached docs - both sides of the PCN, and screenshot of parking charges paid.

We had arrived at 12.04pm into the carpark, and I had paid for 4 hours of parking via RingGo, from 12.13pm onwards at a cost of £7.20

At 16.25, knowing we wouldn't be back in time, I topped up the parking by another hour for £2.30. The pdf receipts in the RingoApp shows the exact times of the transactions, though the screenshots attached do not.

We got back to the car around 17.25, and eventually left the car park at 17:45.

I would like to ask a couple of questions.

1. Having paid in total £9.50, which is the daily rate for this car park, but in 2 payments, is this enough to cancel the PCN?

2. The PCN was received more than 14 days after the date, is this enough to cancel/appeal the ticket?

When i write the appeal on the Smart Parking website, and copy and paste the blue text on the Newbie post, should i add these 2 points at the end in order to resolve the dispute quicker?

    Just appeal to Smart Parking saying you can see they didn’t use the POFA wording nor posted their purported NTK in time for keeper liability so their choices are: cancel it or lose at POPLA.

    And obviously you WILL NOT be ticking ‘driver’ or adding any words that suggest you were driving.

    All this is covered already in the NEWBIES thread, where I specifically mention Smart Parking as not bothering with the POFA  so they are never able to hold keepers liable, not even if they’d posted that earlier.

    easy peasy as long as the driver is not admitted.

    I would not finish any business type letter, especially one to someone who is trying to rip you off the the tune of £100, with "Kindest Regards".  My closing salutation would be way more acerbic but you could try "yours faithfully" for a letter starting Dear Sirs.
  • Hi Guys,
    Smart parking rejected my appeal. Please see attached documents regarding why.
    The NTK according to them was sent within sufficient time, even if it missed the POPLA deadline.
    Please advise if I have any other options.
    20 mins to find parking, and 20 mins to leave on the day with kids etc is that unreasonable?

    FWIIW. imo it is very likely that a judge would take your side if this went to court. 

    Have you complained to your MP, the local paper,  the Chamber of Commerce, and the Tourist Office?  Have you written bad stuff on TripAvviser and Facebook?
    You never know how far you can go until you go too far.
