To sure where to start

I have recently discovered i have a CCJ, which i knew nothing about, for a PCN that I know nothing about. After a little digging i have discovered I have been issued a PCN for an event in September 2017 which has resulted in a CCJ. I haven’t received any letters or any other form of communication regarding this alleged event. I have discovered it is from Civil Enforcement who i spoke to querying this charge and CCJ. The person I spoke to said I can either apply to set it aside at a cost of 100 pounds, I could make a formal application at a cost of 250 pounds and additional court fees or pay a slightly reduced charge which still amounts to nearly 200 pounds. I am reluctant to pay for anything I know nothing about or to admit to something that happened 4 years ago that iI have no recollection of.

The only reason I became aware of any CCJ was following a check on my credit status as part of a process to be accepted onto the new enterprise allowance scheme as i am wanting to start my own business following my recent redundancy. I am confused by it all and the laws and legalities are giving me a headache. Citizens advice tell me to just pay the reduced amount and move on but I don’t see why I should hand over 200 pounds for something I know nothing about. I don’t have 200 pounds spare for that matter.

Any advice as to what I should do first would be great. I don’t know who to contact to appeal against this so don’t know where to start. I have read quite a lot of he newbies threads on this forum but there is so much information, I don’t know which is applicable, if any, to my particular case.

Please help.

Thanks in advance.

You cannot appeal a CCJ , you can apply for a set aside , it's complicated and can be costly , one is £100 plus payment in full , of everything

The other is a contested set aside costing £255

    Neither is an appeal

If the CCJ is more than one month old , paying it won't remove it , merely mark it as satisfied , so see if it's more than one month old

There is no easy getout and unless you get help with fees , it's costly too

Prepare for brain freeze , read this thread as well as the second post in the newbies FAQ sticky thread near the top of the forum in announcements

If the deadline to pay the judgment, set by the court, has passed, paying anything to CEL now will not materially alter the affect the CCJ is having on your credit rating. Do not knee-jerk thinking that paying them gets rid of your problem, it doesn't.

Please read the NEWBIES FAQ Announcement, second post, where the section of it dealing with CCJs and Set Asides explains the options open to you. Come back on this thread once you understand how this all works and receive further advice.
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

  • The CCJ was issued in 2018 so way past the one month deadline. Its the fact I knew nothing about it until I did a credit check that's frustrating for me. I will have a look through the newbie FAQ posts again and see if I can u derstand what, if anything, there is I can do. Thanks guys

You only need to do Control and f on a laptop (not a phone) and search the newbie thread for the phrase ‘set aside’ or the word CCJ.  Takes seconds.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
