Updated Success Settled, Myself Taking Parking Eye POPLA or Parking Site owner to court

    Have you incurred any other expences?  IMO PE was not the right PPC to pursue this caper, they are far too pragmatic.  
    You never know how far you can go until you go too far.

    I did not submit the MCOL to date, I wrote to Parking Eye informing them of my actions and they have now asked to settle. 

    So despite my time and effort no expenses incurred. 

    The alternative to my course of action was to ignore the charge and wait for Parking Eye to commence a claim. Or worse still farm out the case to a robo claim operative. An unspecified period of waiting and an occurrence at possibly some inconvenient future date. 

    Parking Eye were the receiver of the Parking Charge and Citizens Advice confirmed that they were the entity to make the MCOL against.

    How convenient and all within a week.

    Can you post a redacted copy of their letter/ email.
  • No problems, I will post a redacted screenshot of the email from Parking Eye.

    Once you pay the charge the Parking Operator knows they have achieved a hollow victory against you. The tables are then turned on them.

    You must do all the things previously mentioned on the forum. 

    Do NOT ignore the charge. Go through the appeals to POPLA just to show reasonablenous  on your part 

    Inform the Parking Charger you are paying under Duress and without prejudice. That you intend to commence action to recover the costs in the County Court and give them 7 days to consider their position.

    Could be they have so much to hide that they don't want it to come out in court.
    Next time someone should try with added costs £100,  See how far they are prepared to go to cover this up

    No, not if they want the quick resolution that this approach achieved , unlike the alternative advice which is to wait in uncertainty as to how and when the parking charge will progress.

    Pay 99% of parking companies and that's the last you will see of your money regardless if you tell them you pay under Duress ?

    You might take them to court but the majority will just write it off because going to court alone is stressful.  We still stick to .... "DON'T PAY BUT DO NOT IGNORE"

    Why do we say "WAIT" ....... because we know that given the millions of tickets issued, only a few go to court, otherwise the courts will be over run which would collapse the cout system.

    Even with a LBA, the threat, given the right response, they often go away. 
    The whole industry works on a bluff

    So no, we could never suggest just pay up

    If you ever get a parking ticket from another parking company, those seen on here, I wish you luck with your plan

    Indeed, some/a lot who come here struggle with even the simplest situations,   
    You never know how far you can go until you go too far.

    You views seem to confirm the 100% infallibility of the approach of paying under duress then proceeding on the motorists terms and not the parking charge operatives.

    Paying removes any uncertainty into when it will return to bother you to defend it again. 

    The only uncertainty is whether the motorist wishes to pursue repayment of the incorrect charge.  

    On reflection and with honesty a lot of motorists who get into difficulty with parking charge notices on this forum will have wished they had paid them even if they were wrongly issued. 

    But it's tough getting this subtle point over to the somewhat intentionally obtuse  sages of this forum.
