Waiting for Management Pack

So, I'm currently buying my first home, we've been going 7 months and still no closer to exchange/completion :neutral: 

But the one thing holding us up right now is the management pack, this was requested around 5 weeks ago, they told us it would be a 15 day wait... and have now said another 2 weeks, I'm very frustrated as this as the whole purchase has gone on a lot longer than it should've!

My question is, do we definitely need to have the management pack to be able to exchange? I know it's advisable that we do hold out for it but I want to know if there's anything in place that says you definitely need it... we know someone who has bought on the same street and they went ahead without as they were waiting too long for it, I don't know whether there's a real need to have it?

I know my solicitor won't be happy at me suggesting going ahead without but I can't cope with this much longer, it's no chain so we shouldn't still be doing this 7 months later.

    It's not up to you or your solicitor, it's your mortgage lender that won't let you exchange without it.

    They haven't said at all that we need this thought, it hasn't come up in our paperwork.
    No, it won't be in your paperwork, but it forms part of what the solicitors are doing on behalf of the lender.

    If you want to spend all that money on a property but not be recorded as the legal owner, then you go tell your solicitor that you don't want the management information pack.  I can absolutely guarantee though that your lender will want their charge registered against the property so you are going to have to wait.    Just another of the reasons why leaseholds take so much longer.   

    (I'd be very surprised if someone did go ahead without knowing management company/landlord requirements though, especially if there is a restriction on the title, which there usually is!)

    The seller needs to chase this up. 

    • The seller should ask their solicitor when the request for the management pack was sent, and who it was sent to (and whether the solicitor got any kind of acknowledgement / reply etc)
    • Then the seller should contact the management co and ask why a management pack hasn't ben sent
    • The management co might say they haven't received the request, so the seller should ask for the name and contact details of the person who the request should go to and the fee payable. Then the seller should pass that info to their solicitor, and tell them to request the pack again.
    • The seller needs to continue to chase the solicitor and management co until the management pack is provided

    Maybe the OP could ask the EA to confirm that the seller has actually paid the fee for the management pack!
