Sitting ducks for PPCs if the same amount of fastidiousness is applied to reading signage! To extend the agricultural reference - lambs to the slaughter.Coupon-mad said:Yep, none of the advice says ‘email as well’ and bargepole explains why NOT to use MCOL, in his post I show in the NEWBIES thread under the red heading ‘Important - know what happens when’.
We now had this said 3 times in as many days and one Defendant even went ahead and ignored the advice to email it and hacked the Defence to a third its size and shoved it in on MCOL without wondering ‘maybe I’ve missed something’... we still don’t know what they removed. Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

Oh dear , words fail me !! Dunno why we bother1

I guess I deserved that telling off. But on a positive note, I have emailed the defence to CCBCAQ@Justice.gov.uk and a copy to the claimant's solicitors.3
-
Good , now check for email auto responses from both recipients , also check the MCOL claim history this week and ensure that the Defence is received and more importantly , logged by the CCBC , too many going missing recently !! , Check don't assume , it's not submitted until the CCBC show it as logged3

Just to say that I will be watching this with great interest as I too will be using 'forbidding signage' as part of my defence. Good luck ashthemashThe pen is mightier than the sword ..... and I have many pens.3

I have now received another claim from the same claimant at the same spot on a different date. There might be more to come. Is there anything I need to do differently or do I treat each separately on their own merit?0

Yep, search the forum for Henderson estoppel as you will need an extra point about unlawful duplicate claims that should all have been advanced as one claim.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Hi all, my court hearing is finally here. It's scheduled for tomorrow. Gladstones have stated they will not be attending, hopefully this will go in my favour. Please wish me luck.0
-
They won't attend but they will send a rent-by-the-hour legal bod. It might go in your favour as whoever they send will not have had time to read the defence and witness statements of yourself and claimant. You, of course, will be fluent in your defence.1

You have of course filed and served your WS, exhibits and costs notice already at the relevant time?1
