Issue Ending Tenancy

Is it too late to move back in and stay until the courts eventually evict you in 2023? See which option the LL prefers then! 😤 bet they’d be changing their tune to say they’d accepted your notice.
Good luck and hope you get your deposit back ok!3 -
You know I wish I could!! I didn’t put it in my original post but he’s been a complete nightmare LL.
Just hoping he isn’t going to say the agent got it wrong and it’s not what he said…
what makes me laugh, is he issues a S21 and said we can leave with a months notice, now emails the agent saying he’s shocked that we think we can walk away from our contract and obligations….Thanks for the good luck, we will need it0 -
Have you actually given the keys back already if you’re paid up until the end of September?I think someone needs to spell out to the LL the possible alternative scenario even if you aren’t actually able to move back in, they don’t know that 😂
They should be thrilled you’ve gone really.1 -
Binding contract made, they act on his behalf so ll does not have a leg to stand onDon't put your trust into an Experian score - it is not a number any bank will ever use & it is generally a waste of money to purchase it. They are also selling you insurance you dont need.1

Sending the keys back today to the agency recorded delivery.Yeah the landlord was totally inflexible, even when we asked earlier in the year if we could stay a few extra months, it was a no you must be out on your move out date.
They clearly have they’re own ideas and expect everyone else to jump to those ideas.
Like you say on the other side of the coin, LL would be going mental if we refused to leave.
I have the emails, I guess all I can do is send the keys back and move on with my life.
Thanks 😊0 -
For future reference, you don't have to move out at the end of the S21 notice. It's just a notice saying the landlord would like you to move out on that date, a landlord cannot end the tenancy. You are still fully entitled to reside at the property after an S21 expires. You are only legally obliged to leave at the end of notice you give, or when a court issues an eviction order.TenancyAdvicePls said:Sending the keys back today to the agency recorded delivery.Yeah the landlord was totally inflexible, even when we asked earlier in the year if we could stay a few extra months, it was a no you must be out on your move out date.

TenancyAdvicePls said:Sending the keys back today to the agency recorded delivery.I would not do this. Your tenancy does not end till 30th Sept (unless I've mis-rememberd earlier details!).That means you remain responsible for andliable for the property till then. At the very least, you should return on 30th to read the meters and obtain final utility bills. And with keys returned you'll have no idea if anyone goes in between now and then - yet any damage will be your responsibility. The final check-out inspection should happen after 30th. Till then, you remain the tenant.4

Agree with the above. OP - do not return keys yet. Ideally you return them in person on the last day of your tenancy, not three weeks before by post.

Thanks for the comments. The only issue we have is we won’t be local anymore and don’t have anyone to return them on our behalf.
We have taken videos, and uploaded them on a private setting on YouTube for stamped date and time.
after speaking with CAB now and Shelter again, they both see it as an issue for the court to settle and think the landlord is being petty.0 -
Whilst you may not be local anymore, you have 3 weeks to make arrangements to be able to be local for that day. If it was me I'd choose that path - safest all round.Jenni x2
