have read all the comments so far and am not going to add further to the right or wrongs but will give an opinion.
I personally cant see the harm in being featured in a pamphlet or having my photo taken, if in this instance it saves the care home money. I fail to see how any distress is caused that necessitates court action and compensation. The car home will now incur higher insurance costs, the cost of new marketing material, photographer and printing so in my mind the only people that will suffer here will be the care residents. each to their own I suppose2 -

First hearings are often used to settle the case law with follow up hearing for awards, so I'd be fascinated to hear the details.Some days, it's just not worth chewing through the leather straps....

Indeed, I uncovered a cover up of assaults at the home which led to a multi agency investigation, one local council put a temporary embargo on the home, another Council have stated they will not send any residents t the home
I am happy for you to read the summation but I would prefer for the parties to remain anonymous, so if you can advise me how to access this, I will send you the summation with the identities removed0 -
You would need to go onto the relevant court page on HMCS, download the summation and redact all the names. Considering that no reference would have been made to any of those assaults in your claim about unauthorised use of your image, no one involved in that would have been mentioned in the case papers.

I'm curious - what summation are we talking about? If this was a claim in the small claims track then all there'll be is a judgment/order of the court - the OP would have received a copy of that. There won't be any transcript unless someone has requested (and paid for) one.Jenni x1
