    Oh 100% and that is why I wanted to actually speak to someone rather than allow him / them to just hide behind emails while they carry out their corrupt practices.  Not had a great week, so suppose frustration got the better of me and I wanted to let this person know what I thought of him and his company.  

    I am going to complain to the ICO about the way have dealt with the SAR and told him that he would get an honourable mention in the complaint.

    Just just a quick update - I contacted the County Business Court today, as I received a letter from them on 14th September saying that they had received my defence and it had been forwarded to Excel Parking.   I said that I hadn't heard anything further and the MCOL website was showing my defence as the last activity, so I asked them for an update.  They said my case was showing as 'stayed' on their system and Excel Parking would have to pay a fee to lift that.  As the fee is likely to be not far off what they are claiming, then I'm guessing they won't be continuing with it?

    Fully expecting to still be receiving demands from their 'legal representatives' though.

    The actual legal guy at Excel is well known , been mentioned previously on here and has the initials JB !

    The legal guy JB is Registered with the SRA , quite rightly so , but I would not assume that the guy you spoke to has legal qualifications or is registered with the SRA !  Not unless they prove it !

    They might be negligently or deliberately doing what BW Legal did a couple of years ago, and (whether intended or not) 'warehousing' claims for a year or two then suddenly paying to lift the stays.

    Whether deliberate or not, it is sharp practice IMHO and BW Legal caught loads of defendants out, particularly people who had thrown their evidence away and worse, those who had moved house and therefore never heard about it until they got a CCJ behind their back.

    Hopefully it is none of the above and Excel have just dropped the ball and you've won and they won't try again.  But to cover yourself, keep ALL the paperwork and emails, evidence, their SAR reply, all your defence, etc.

    And if you move house, tell their DPO by email to erase the old address.  And tell the CCBC to update their records if the useless (endless) stayed claim has not been struck out.
